reg 94 Evidence given in private

A special measures direction may not provide for the exclusion of persons under section 25 of the 1999 Act unless— (a) the proceedings are in respect of— (i) a sexual offence, (ii) a modern slavery offence, or (iii) any other offence where it is alleged that the behaviour of the defendant amounted to domestic abuse ; or (b) it appears to the judge advocate that there are reasonable grounds for believing that any person other than a defendant has sought, or will seek, to intimidate the witness in connection with testifying in the proceedings.
