(1) A project licence that would authorise the application of regulated procedures to non-endangered primates must not be granted unless the Secretary of State has verified that the following conditions are met— (a) Condition 4 or 5; and (b) Condition 6. (2) Condition 4 is that the programme of work to be specified in the licence is to be carried out— (a) for the purpose mentioned in paragraph (b)(i) or (c) of section 5C(3); and (b) for the purpose of the avoidance, prevention, diagnosis or treatment of debilitating or potentially life-threatening clinical conditions in man. (3) Condition 5 is that the programme of work to be specified in the licence is to be carried out for the purpose mentioned in paragraph (a) or (e) of section 5C(3). (4) Condition 6 is that there is scientific justification to the effect that the purpose of the programme of work to be specified in the licence cannot be achieved by the use of animals which are not primates.
