(1) Subject to paragraph (2), a person must not operate an offshore combustion installation— (a) without a permit; and (b) otherwise than in accordance with the conditions in that permit. (2) Where a permit has yet to be granted in respect of an offshore combustion installation which is equipped with a medium combustion plant, paragraph (1) applies from the relevant date. (3) A person must apply for a permit in writing to the Secretary of State.
