(2) The Secretary of State, or relevant authority, responsible for determining an application for EIA development under these Regulations must ensure that the environmental statement submitted in respect of that application is available on the website referred to in the notices published or posted pursuant to these Regulations and regulation 9 of the Infrastructure Planning (Applications: Prescribed Forms and Procedure) Regulations 2009 .
