reg 30 Decision notices

(1) Where— (a) the Secretary of State has determined an application for an order granting development consent for EIA development; or (b) the relevant authority has determined a subsequent application, a notification of the decision must be given to the applicant (“the decision notice”) which must include the information specified in paragraph (2). (2) The information is— (a) information regarding the right to challenge the validity of the decision and the procedures for doing so; and (b) if the decision is — (i) to approve the application— (aa) the reasoned conclusion of the Secretary of State or the relevant authority, as the case may be, on the significant effects of the development on the environment, taking into account the results of the examination referred to, in the case of an application for an order granting development consent in regulation 21, and in the case of a subsequent application, in regulation 25; (bb) where relevant, any requirements to which the decision is subject which relate to the likely significant environmental effects of the development on the environment; (cc) a description of any features of the development and any measures envisaged in order to avoid, prevent or reduce and, if possible, offset, likely significant adverse effects on the environment; and (dd) any monitoring measures considered appropriate by the Secretary of State or relevant authority, as the case may be; or (ii) to refuse the application, the main reasons for the refusal.
