s 58 Mode of application
(1) An application for relief under this Part shall be made by summons in Form MS 12 or MS 13, whichever is appropriate.
(2) Subject to subsection (3), a summons under this section shall be supported by an affidavit stating that the applicantβ
(a) claims no interest in the subject matter in dispute other than for charges or costs;
(b) does not collude with any of the claimants to that subject matter; and
(c) is willing to pay or transfer that subject matter into Court or to dispose of it as the Court may direct.
(3) Where the applicant is a bailiff, he shall not provide such affidavit as is referred to in subsection (2) unless the Court otherwise orders.

Cara membuat permohonan
(1) Sesuatu permohonan untuk mendapatkan relief di bawah Bahagian ini hendaklah dibuat melalui saman dalam Borang MS 12 atau MS 13, mengikut mana-mana yang sesuai.
(2) Tertakluk pada subseksyen (3), suatu saman di bawah seksyen ini hendaklah disokong dengan afidavit yang menyatakan bahawa pemohon ituβ
(a) tidak menuntut apa-apa kepentingan dalam hal perkara yang dipertikaikan selain caj atau kos;
(b) tidak berpakat sulit dengan mana-mana pihak menuntut dalam hal perkara itu; dan
(c) sanggup membayar atau memindahkan hak perkara itu ke dalam Mahkamah atau membereskannya sebagaimana yang diarahkan oleh Mahkamah.
(3) Jika pemohon ialah seorang bailif, dia tidak boleh memberikan apa-apa afidavit yang disebut dalam subseksyen (2) melainkan jika diperintahkan selainnya oleh Mahkamah.
