s 72 Defences
(1) In any civil proceeding under this Part against any person in respect of a defect in a product, it shall be a defence for that person to show—
(a) that the defect is attributable to compliance with any requirement imposed under any written law;
(b) that he did not at any time supply the defective product to another person;
(c) that the defect did not exist in the product at the relevant time;
(d) that the state of scientific and technical knowledge at the relevant time was not such that a producer of products of the same description as the product in question may reasonably be expected to discover the defect if it had existed in his product while it was under his control; or
(e) that the defect—
(i) is a defect in a product in which the product in question is comprised therein (the “subsequent product”); and
(ii) is wholly attributable to—
(A) the design of the subsequent product; or
(B) compliance by the producer of the product in question with instructions given by the producer of the subsequent product.
(2) For the purposes of subsection (1), “relevant time”—
(a) in relation to electricity, means the time at which it was generated, being a time before it was transmitted or distributed; and
(b) in relation to any other product, means—
(i) where section 68 applies, the time when the producer supplied the product to another person; and
(ii) where section 68 does not apply, the time when the product was last supplied by a person to whom section 68 applies to another person.

Pembelaan
(1) Dalam apa-apa prosiding sivil di bawah Bahagian ini terhadap mana-mana orang berkenaan dengan sesuatu kecacatan pada sesuatu keluaran, adalah menjadi suatu pembelaan jika orang itu menunjukkan—
(a) bahawa kecacatan itu adalah disebabkan oleh pematuhan mana-mana kehendak yang dikenakan di bawah manamana undang-undang bertulis;
(b) bahawa dia tidak pada bila-bila masa membekalkan keluaran yang cacat itu kepada orang lain;
(c) bahawa kecacatan itu tidak wujud pada keluaran itu pada masa yang berkaitan;
(d) bahawa tahap pengetahuan saintifik dan teknikal pada masa yang berkaitan itu tidaklah sedemikian rupa sehingga pengeluar keluaran sama perihalnya dengan keluaran yang berkenaan itu dapat dengan munasabah dijangkakan akan mengesan kecacatan itu jika kecacatan itu wujud pada keluarannya semasa keluaran itu di bawah kawalannya; atau
(e) bahawa kecacatan itu—
(i) ialah suatu kecacatan pada sesuatu keluaran yang terkandung dalamnya keluaran yang berkenaan (“keluaran yang berikutnya”); dan
(ii) disebabkan pada keseluruhannya oleh—
(A) reka bentuk keluaran yang berikutnya; atau
(B) pematuhan arahan yang diberikan oleh pengeluar keluaran yang berikutnya oleh pengeluar keluaran yang berkenaan.
(2) Bagi maksud subseksyen (1), “masa yang berkaitan”—
(a) berhubung dengan elektrik, ertinya masa elektrik itu dijanakan, iaitu masa sebelum elektrik itu dihantar atau diagihkan; dan
(b) berhubung dengan apa-apa keluaran lain, ertinya—
(i) jika seksyen 68 terpakai, masa pengeluar membekalkan keluaran itu kepada seorang lain; dan
(ii) jika seksyen 68 tidak terpakai, masa keluaran itu terakhir dibekalkan oleh seseorang yang baginya seksyen 68 terpakai kepada seorang lain.
