s 31 Request for enforcement of foreign forfeiture order

(1) The appropriate authority of a prescribed foreign State may request the Attorney General— (a) to assist in the enforcement and satisfaction of a foreign forfeiture order made in any judicial proceedings instituted in that prescribed foreign State against property that is reasonably believed to be located in Malaysia; or (b) where a foreign forfeiture order may be made in judicial proceedings which have been or are to be instituted in that prescribed foreign State, to assist in the restraining of dealing in any property that is reasonably believed to be located in Malaysia and against which the order may be enforced or which may be available to satisfy the order. (2) On receipt of a request referred to in subsection (1), the Attorney General may— (a) in the case of paragraph (1)(a), act or authorize the taking of action under section 32 and the regulations made pursuant to section 44; or (b) in the case of paragraph (1)(b), act or authorize the taking of action under the regulations made pursuant to section 44, and in that event section 32 and the regulations made pursuant to section 44 shall apply accordingly.

(1) Pihak berkuasa yang berkenaan sesuatu Negara asing yang ditetapkan boleh meminta Peguam Negara- (a) membantu menguatkuasakan dan menunaikan suatu perintah pelucuthakan asing yang dibuat dalam manamana prosiding kehakiman yang dimulakan di Negara asing yang ditetapkan itu terhadap harta yang dipercayai dengan munasabahnya terletak di Malaysia; atau (b) jika suatu perintah pelucuthakan asing boleh dibuat dalam prosiding kehakiman yang telah atau akan dimulakan di Negara asing yang ditetapkan itu, membantu menyekat urusan mengenai apa-apa harta yang dipercayai dengan munasabahnya terletak di Malaysia dan yang terhadapnya perintah itu boleh dikuatkuasakan atau yang ada untuk menunaikan perintah itu. (2) Apabila suatu permintaan yang disebut dalam subseksyen (1) diterima, Peguam Negara boleh- (a) dalam hal perenggan (1)(a), bertindak atau memberi kuasa bagi tindakan diambil di bawah seksyen 32 dan peraturanperaturan yang dibuat menurut seksyen 44; atau (b) dalam hal perenggan (1)(b), bertindak atau memberi kuasa bagi tindakan diambil di bawah peraturan-peraturan yang dibuat menurut seksyen 44, dan dalam hal itu seksyen 32 dan peraturan-peraturan yang dibuat menurut seksyen 44 hendaklah terpakai dengan sewajarnya.
