s 19 Grant or refusal of licence

(1) The Director General may, after considering the application for a licence under section 16, and the additional information or document provided under section 17 and having due regard to the recommendation of the Corporation under section 18, grant the licence or refuse to grant the licence. (2) If the Director General decides to grant a licence under subsection (1), he shall— (a) require the licensee to pay the prescribed fee within the prescribed period; and (b) impose conditions as he thinks fit. (3) The conditions which may be imposed under subsection (2) include— (a) the nature, extent and frequency of services to be provided by the licensee; (b) the duration of the licence; (c) the area and scheme for which the licensee shall provide such services; (d) the types of controlled solid waste; (e) the solid waste management facilities to which collected solid waste may be delivered to; (f) the requirement to deposit such amount as may be prescribed as security for safe closure of solid waste management facilities; (g) the annual licence fee payable by the licensee, or if the Director General thinks it expedient, the lump sum licence fee payable by the licensee for the whole duration of the licence; and (h) the particular rights and duties of the licensee in respect of the services to be provided by the licensee. (4) The decision of the Director General to grant or not to grant a licence shall be communicated to the applicant by written notice as soon as practicable. (5) The written notice by the Director General under subsection (4) shall specify— (a) in the case where the licence is granted, the fact of such grant and the requirements and conditions imposed under subsection (2); and (b) in the case of a refusal to grant a licence, the fact of such refusal and the reason for the refusal.

Pemberian atau keengganan memberikan lesen

(1) Ketua Pengarah boleh, selepas menimbangkan permohonan untuk mendapatkan lesen di bawah seksyen 16, dan maklumat atau dokumen tambahan yang diberikan di bawah seksyen 17 dan dengan mengambil kira dengan sewajarnya syor Perbadanan di bawah seksyen 18, memberikan lesen atau enggan memberikan lesen. (2) Jika Ketua Pengarah memutuskan untuk memberikan lesen di bawah subseksyen (1), Ketua Pengarah hendaklah— (a) menghendaki pemegang lesen itu membayar fi yang ditetapkan dalam tempoh yang ditetapkan; dan (b) mengenakan syarat yang difikirkannya patut. (3) Syarat-syarat yang boleh dikenakan di bawah subseksyen (2) termasuklah— (a) jenis, takat dan kekerapan perkhidmatan yang hendaklah disediakan oleh pemegang lesen; (b) tempoh lesen; (c) kawasan dan skim yang baginya pemegang lesen itu hendaklah menyediakan apa-apa perkhidmatan; (d) jenis sisa pepejal terkawal; (e) kemudahan pengurusan sisa pepejal yang kepadanya sisa pepejal yang dipungut dihantar; (f) kehendak untuk mendeposit apa-apa amaun sebagaimana yang ditetapkan sebagai jaminan bagi penutupan selamat kemudahan pengurusan sisa pepejal; (g) fi lesen tahunan yang kena dibayar oleh pemegang lesen, atau jika didapati suai manfaat oleh Ketua Pengarah, jumlah penuh fi lesen yang kena bayar oleh pemegang lesen bagi keseluruhan tempoh lesen itu; dan (h) hak dan kewajipan tertentu pemegang lesen berkenaan dengan perkhidmatan yang disediakan oleh pemegang lesen itu. (4) Keputusan Ketua Pengarah untuk memberikan lesen atau tidak hendaklah disampaikan kepada pemohon melalui notis bertulis secepat yang dapat dilaksanakan. (5) Notis bertulis oleh Ketua Pengarah di bawah subseksyen (4) hendaklah menyatakan— (a) dalam hal jika lesen diberikan, hakikat mengenai pemberian itu dan kehendak dan syarat yang dikenakan di bawah subseksyen (2); dan (b) dalam hal suatu keengganan untuk memberikan lesen, hakikat mengenai keengganan itu dan sebab bagi keengganan itu.
