s 30 Suspension or revocation of approval or licence
(1) The Director General may suspend or revoke an approval or a licence if he is satisfied that—
(a) the holder of an approval or the licensee has—
(i) obtained the approval or licence by any false or misleading statement;
(ii) breached any term or condition imposed by the Director General on the approval or licence;
(iii) failed to comply with any of the provisions of this Act;
(iv) been convicted for an offence under this Act or any other written law;
(v) failed to comply with any directive, order or guideline given to him or it by the Minister or the Director General;
(vi) used the premises to which the approval or licence relates contrary to the purpose of which the approval or licence is granted;
(vii) operated or provided the licensed pathology laboratory in a manner which is detrimental to the interest of the public as the Director General may decide;
(viii) established or maintained policies or issued directives that result in the healthcare professional employed or engaged by the pathology laboratory contravening the code of professional conduct issued by the relevant body governing such healthcare professional;
(ix) ceased to operate or provide the licensed pathology laboratory for more than thirty days without prior notice given and approval obtained from the Director General; or
(x) failed to maintain the standard and quality required for the operation of the licensed pathology laboratory; or
(b) where the holder of an approval or the licensee—
(i) is a sole proprietor, whose name has been struck off or suspended from the Malaysian Medical Register pursuant to subparagraph 30(i) or (ii) of the Medical Act 1971; or
(ii) is a body corporate or partnership, which does not remove a member of its board of directors or
partner, as the case may be, who is a registered medical practitioner, whose name has been struck off or suspended from the Malaysian Medical Register pursuant to subparagraph 30(i) or (ii) of the Medical Act 1971.

Penggantungan atau pembatalan kelulusan atau lesen
(1) Ketua Pengarah boleh menggantung atau membatalkan suatu kelulusan atau lesen jika dia berpuas hati bahawa—
(a) pemegang kelulusan atau pemegang lesen telah—
(i) memperoleh kelulusan atau lesen melalui apa-apa pernyataan palsu atau mengelirukan;
(ii) melanggar apa-apa terma atau syarat yang dikenakan oleh Ketua Pengarah ke atas kelulusan atau lesen;
(iii) gagal untuk mematuhi mana-mana peruntukan Akta ini;
(iv) disabitkan bagi suatu kesalahan di bawah Akta ini atau mana-mana undang-undang bertulis lain;
(v) gagal untuk mematuhi apa-apa arahan, perintah atau garis panduan yang diberikan kepadanya oleh Menteri atau Ketua Pengarah;
(vi) menggunakan premis yang dengannya kelulusan atau lesen itu berkaitan berlawanan dengan maksud kelulusan atau lesen itu diberikan;
(vii) mengendalikan atau meyediakan makmal patologi berlesen itu mengikut cara yang menjejaskan kepentingan orang awam sebagaimana yang diputuskan oleh Ketua Pengarah;
(viii) menubuhkan atau menyenggara dasar atau mengeluarkan arahan yang mengakibatkan profesional jagaan kesihatan yang diambil kerja atau diguna khidmat oleh makmal patologi melanggar tatalaku profesional yang dikeluarkan oleh badan yang berkaitan yang mengawal profesional jagaan kesihatan itu;
(ix) berhenti untuk mengendalikan atau menyediakan makmal patologi berlesen selama lebih daripada tiga puluh hari tanpa memberikan notis dan memperoleh kelulusan terlebih dahulu daripada Ketua Pengarah; atau
(x) gagal untuk mengekalkan piawaian dan kualiti yang dikehendaki bagi pengendalian makmal patologi berlesen itu; atau
(b) jika pemegang kelulusan atau pemegang lesen—
(i) merupakan tuan punya tunggal, yang namanya telah dipotong atau digantung daripada Daftar Perubatan Malaysia menurut subperenggan 30(i) atau (ii) Akta Perubatan 1971; atau
(ii) merupakan suatu pertubuhan perbadanan atau perkongsian, yang tidak menyingkir anggota lembaga pengarah atau pekongsinya, mengikut mana-mana yang berkenaan, yang merupakan pengamal perubatan berdaftar, yang namanya telah dipotong atau digantung daripada Daftar Perubatan Malaysia menurut subperenggan 30(i) atau (ii) Akta Perubatan 1971.
