s 77 Furnishing of information

(1) The Director General may from time to time direct the holder of an approval or the licensee to furnish such information on the licensed pathology laboratory as he may require relating to— (a) its staff; (b) any equipment, materials or any other things used or to be used; (c) the diagnosis of any person whose sample has been tested; (d) any analytical method or procedure used in carrying out any test; (e) its operation; (f) all matters relating to policy statement; or (g) the duties, functions and experience of locum tenens and honorary consultants, their experience and supervision and restrictions on their activities. (2) A holder of an approval or the licensee who refuses or fails to furnish information under subsection (1) or gives any false or misleading information, commits an offence and shall, on conviction, be liable— (a) in the case of sole proprietor, to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year, or to both; and (b) in the case of a body corporate or partnership to a fine not exceeding thirty thousand ringgit. (3) Nothing in this section shall authorize the Director General or any officer authorized by him to inspect the medical record of any person whose sample has been tested in a licensed pathology laboratory or to obtain any information in respect of any person on any matter specified under paragraph (1)(c) without the prior written consent of the person or his representative. (4) Notwithstanding subsection (3), the Director General or any officer authorized by him may inspect any record or material for the purposes of section 53, 54, 55 or 56 without the prior written consent of the person or his representative. (5) The inspection under subsection (4) shall be for the purpose of determining the compliance with the provisions of this Act and regulations made under this Act by the licensee, the holder of an approval or the person in charge of the licensed pathology laboratory, and the confidentiality of any information of any person obtained during such inspection shall be observed. (6) For the purposes of subsections (3) and (4), “representative” of a person means— (a) if a person is a deceased, his executor, administrator or next of kin; (b) if the person is a minor, his mother, father or guardian; or (c) if the person is not capable of giving consent, his next of kin.

(1) Ketua Pengarah boleh dari semasa ke semasa mengarahkan pemegang kelulusan atau pemegang lesen untuk memberikan apa-apa maklumat mengenai makmal patologi berlesen sebagaimana yang dikehendaki olehnya yang berhubungan dengan— (a) kakitangannya; (b) apa-apa kelengkapan, material atau apa-apa benda lain yang digunakan atau akan digunakan; (c) diagnosis mana-mana orang yang sampelnya telah diuji; (d) apa-apa kaedah atau tatacara analitis yang digunakan dalam menjalankan apa-apa ujian; (e) pengendaliannya; (f) semua perkara yang berhubungan dengan pernyataan dasar; atau (g) tugas, fungsi dan pengalaman locum tenens dan perunding kehormat, pengalaman dan penyeliaan mereka serta sekatan ke atas kegiatan mereka. (2) Seseorang pemegang kelulusan atau pemegang lesen yang enggan atau gagal untuk memberikan maklumat di bawah subseksyen (1) atau memberikan apa-apa maklumat yang palsu atau mengelirukan, melakukan suatu kesalahan dan boleh, apabila disabitkan— (a) dalam hal tuan punya tunggal, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun, atau kedua-duanya; dan (b) dalam hal pertubuhan perbadanan atau perkongsian didenda tidak melebihi tiga puluh ribu ringgit. (3) Tiada apa-apa jua dalam seksyen ini boleh memberi kuasa kepada Ketua Pengarah atau mana-mana pegawai yang diberi kuasa olehnya untuk memeriksa rekod perubatan mana-mana orang yang sampelnya telah diuji dalam makmal patologi berlesen atau untuk memperoleh apa-apa maklumat berkenaan dengan manamana orang mengenai apa-apa perkara yang dinyatakan di bawah perenggan (1)(c) tanpa keizinan bertulis orang itu atau wakilnya terlebih dahulu. (4) Walau apa pun subseksyen (3), Ketua Pengarah atau mana-mana pegawai yang diberi kuasa olehnya boleh memeriksa apa-apa rekod atau material bagi maksud seksyen 53, 54, 55 atau 56 tanpa keizinan bertulis orang itu atau wakilnya terlebih dahulu. (5) Pemeriksaan di bawah subseksyen (4) hendaklah bagi maksud menentukan pematuhan peruntukan Akta ini dan peraturan-peraturan yang dibuat di bawah Akta ini oleh pemegang lesen, pemegang kelulusan atau orang yang bertanggungjawab bagi makmal patologi berlesen, dan kerahsiaan apa-apa maklumat mana-mana orang yang diperoleh semasa pemeriksaan itu hendaklah dipatuhi. (6) Bagi maksud subseksyen (3) dan (4), “wakil” seseorang ertinya— (a) jika orang itu sudah meninggal dunia, wasi, pentadbir atau waris kadimnya; (b) jika orang itu belum dewasa, ibu, bapa atau penjaganya; atau (c) jika orang itu tidak berupaya memberikan keizinan, waris kadimnya.
