s 39 Enforcement notice

(1) Where, following the completion of an investigation about an act, practice or request specified in the complaint, the Registrar is of the opinion that the relevant credit reporting agencyβ€” (a) is contravening a provision of this Act; or (b) has contravened such a provision in circumstances that make it likely that the contravention will continue or be repeated, then the Registrar may serve on the relevant credit reporting agency an enforcement noticeβ€” (A) stating that he is of that opinion; (B) specifying the provision of this Act on which he has based that opinion and the reasons why he is of that opinion; (C) directing the relevant credit reporting agency to take such steps as are specified in the enforcement notice to remedy the contravention or, as the case may be, the matters occasioning it within such period as is specified in the enforcement notice; and (D) directing, where necessary, the relevant credit reporting agency to cease processing the credit information pending the remedy of the contravention by the relevant credit reporting agency. (2) In deciding whether to serve an enforcement notice, the Registrar shall consider whether the contravention or the matter to which the enforcement notice relates has caused or is likely to cause damage or distress to the customer of the credit information to which the contravention or matter relates. (3) The steps as specified in the enforcement notice to remedy the contravention or matter to which the enforcement notice relates may be framedβ€” (a) to any extent by reference to any code of practice issued under section 75; or (b) so as to afford the relevant credit reporting agency a choice between different ways of remedying the contravention or matter. (4) The period specified in an enforcement notice under subsection (1) for taking the steps specified in it shall not expire before the end of the period specified in subsection 59(2) within which an appeal against the enforcement notice may be made and, if such an appeal is made, those steps need not be taken pending the determination or withdrawal of the appeal. (5) Notwithstanding subsection (4), if the Registrar is of the opinion that by reason of special circumstances the steps specified in the enforcement notice should be taken as a matter of urgencyβ€” (a) he may include a statement to that effect in the enforcement notice together with the reasons why he is of that opinion; and (b) where such a statement is so included, subsection (4) shall not apply but the enforcement notice shall not require those steps to be taken before the end of the period of seven days from the date on which the enforcement notice was served. (6) An appeal may be made to the Minister against an enforcement notice by the relevant credit reporting agency in accordance with section 59. (7) Where the Registrarβ€” (a) forms an opinion referred to in subsection (1) in respect of the relevant credit reporting agency at any time before the completion of an investigation; and (b) is also of the opinion that, by reason of special circumstances, an enforcement notice should be served on the relevant credit reporting agency as a matter of urgency, he may so serve the enforcement notice notwithstanding that the investigation has not been completed and, in any such caseβ€” (A) the Registrar shall, without prejudice to any other matters to be included in the enforcement notice, specify in the enforcement notice the reasons as to why he is of the opinion referred to in paragraph (b); and (B) the other provisions of this Act, including this section, shall be construed accordingly. (8) A person who fails to comply with an enforcement notice commits an offence and shall, on conviction, be liable to a fine not exceeding two hundred thousand ringgit or to imprisonment for a term not exceeding two years or to both.

Notis penguatkuasaan

(1) Jika, berikutan daripada penyelesaian sesuatu penyiasatan terhadap suatu perbuatan, amalan atau permintaan yang dinyatakan dalam aduan, Pendaftar berpendapat bahawa agensi pelaporan kredit yang berkaitan ituβ€” (a) sedang melanggar sesuatu peruntukan Akta ini; atau (b) telah melanggar sesuatu peruntukan sedemikian dalam hal keadaan yang menjadikan pelanggaran itu berkemungkinan akan berterusan atau berulang, maka Pendaftar boleh menyampaikan suatu notis penguatkuasaan kepada agensi pelaporan kredit yang berkaitanβ€” (A) yang menyatakan bahawa dia berpendapat sedemikian; (B) yang menyatakan peruntukan Akta ini yang berdasarkannya dia berpendapat sedemikian dan sebab-sebab mengapa dia berpendapat sedemikian; (C) yang mengarahkan agensi pelaporan kredit yang berkaitan untuk mengambil apa-apa langkah yang dinyatakan dalam notis penguatkuasaan itu untuk meremedi pelanggaran itu atau, mengikut hal keadaan, perkara yang menyebabkannya dalam apa-apa tempoh yang dinyatakan dalam notis penguatkuasaan itu; dan (D) yang mengarahkan, jika perlu, agensi pelaporan kredit yang berkaitan untuk berhenti memproses maklumat kredit itu sementara menunggu agensi pelaporan kredit yang berkaitan meremedi pelanggaran itu. (2) Pendaftar hendaklah, dalam menentukan sama ada untuk menyampaikan suatu notis penguatkuasaan, menimbangkan sama ada pelanggaran atau perkara yang berhubungan dengan notis penguatkuasaan itu telah menyebabkan atau berkemungkinan akan menyebabkan kerosakan atau distres kepada pelanggan maklumat kredit yang berhubungan dengan pelanggaran atau perkara itu. (3) Langkah yang dinyatakan dalam notis penguatkuasaan untuk meremedi pelanggaran atau perkara yang berhubungan dengan notis penguatkuasaan itu boleh dibuatβ€” (a) sehingga apa-apa takat dengan merujuk kepada mana-mana tataamalan yang dikeluarkan di bawah seksyen 75; atau (b) supaya memberi agensi pelaporan kredit yang berkaitan itu suatu pilihan antara cara-cara yang berlainan untuk meremedi pelanggaran atau perkara itu. (4) Tempoh yang dinyatakan dalam suatu notis penguatkuasaan di bawah subseksyen (1) untuk mengambil langkah yang dinyatakan dalamnya tidak boleh habis tempoh sebelum berakhirnya tempoh yang dinyatakan dalam subseksyen 59(2) yang dalam tempoh itu suatu rayuan terhadap notis penguatkuasaan itu boleh dibuat dan, jika rayuan sedemikian dibuat, langkah itu tidak perlu diambil sementara menunggu penentuan atau penarikan balik rayuan itu. (5) Walau apa pun subseksyen (4), jika Pendaftar berpendapat bahawa oleh sebab hal keadaan khas langkah yang dinyatakan dalam notis penguatkuasaan itu patut diambil atas alasan keterdesakanβ€” (a) dia boleh memasukkan suatu pernyataan yang bermaksud sedemikian dalam notis penguatkuasaan itu berserta dengan sebab-sebab mengapa dia berpendapat sedemikian; dan (b) jika pernyataan itu telah dimasukkan sedemikian, subseksyen (4) tidak terpakai tetapi notis penguatkuasaan itu tidak boleh menghendaki langkah itu diambil sebelum berakhirnya tempoh tujuh hari bermula dari tarikh notis penguatkuasaan itu disampaikan. (6) Sesuatu rayuan boleh dibuat kepada Menteri terhadap suatu notis penguatkuasaan oleh agensi pelaporan kredit yang berkaitan mengikut seksyen 59. (7) Jika Pendaftarβ€” (a) membentuk suatu pendapat yang disebut dalam subseksyen (1) berkenaan dengan agensi pelaporan kredit yang berkaitan pada bila-bila masa sebelum suatu penyiasatan diselesaikan; dan (b) juga berpendapat bahawa, oleh sebab hal keadaan khas, suatu notis penguatkuasaan patut disampaikan kepada agensi pelaporan kredit yang berkaitan atas alasan keterdesakan, dia boleh menyampaikan notis penguatkuasaan itu walaupun penyiasatan itu belum diselesaikan dan, dalam mana-mana hal sedemikianβ€” (A) Pendaftar hendaklah, tanpa menjejaskan apa-apa perkara lain yang hendaklah dimasukkan dalam notis penguatkuasaan itu, menyatakan dalam notis penguatkuasaan itu sebab-sebab mengapa dia mempunyai pendapat yang disebut dalam perenggan (b); dan (B) peruntukan lain Akta ini, termasuk seksyen ini, hendaklah ditafsirkan dengan sewajarnya. (8) Seseorang yang tidak mematuhi suatu notis penguatkuasaan melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.
