s 53 Circumstances in which a postal article may be opened
(1) Subject to regulations made under this Act, a licensee may open a postal article in the following circumstances:
(a) to secure the contents or to ascertain the condition of the contents of damaged postal articles;
(b) to determine the addressee or sender of an undeliverable postal article in accordance with the rules made by the Commission;
(c) if there are reasonable grounds to suspect that there is a physical danger to persons or property;
(d) if there are reasonable grounds to suspect that there is a health risk to persons;
(e) if it has the consent of the addressee or sender to do so;
(f) by an order of court; or
(g) as required by the relevant authorities or any other written law.
(2) An employee of a licensee who has been authorized by the licensee in writing may open postal articles in the circumstances under subsection (1) and in the presence of another employee who has been similarly authorized.
(3) The contents of an opened postal article may be inspected no further than is warranted in the circumstances under subsection
(1).

Hal keadaan apabila barang pos boleh dibuka
(1) Tertakluk kepada peraturan-peraturan yang dibuat di bawah Akta ini, seseorang pemegang lesen boleh membuka barang pos dalam hal keadaan yang berikut:
(a) untuk menyelamatkan isi kandungan atau untuk memastikan keadaan isi kandungan barang pos yang telah rosak;
(b) untuk menentukan penerima atau pengirim barang pos yang tidak dapat diserah menurut kaedah-kaedah yang dibuat oleh Suruhanjaya;
(c) jika terdapat alasan yang munasabah untuk mengesyaki bahawa terdapat bahaya fizikal kepada manusia atau harta;
(d) jika terdapat alasan yang munasabah untuk mengesyaki bahawa terdapat risiko kesihatan kepada manusia;
(e) jika ia memperoleh persetujuan daripada pengirim atau penerima untuk melakukannya;
(f) dengan suatu perintah mahkamah; atau
(g) sebagaimana yang dikehendaki oleh pihak berkuasa berkenaan atau mana-mana undang-undang bertulis yang lain.
(2) Seseorang pekerja pemegang lesen yang telah diberi kuasa secara bertulis oleh pemegang lesen boleh membuka barang pos dalam hal keadaan di bawah subseksyen (1) dan dengan kehadiran pekerja lain yang telah diberi kuasa yang serupa.
(3) Isi kandungan barang pos yang telah dibuka bolehlah diperiksa tetapi tidak lebih daripada yang diwajarkan dalam hal keadaan di bawah subseksyen (1).
