s 84 Release of books, records, accounts, documents, etc., seized

(1) If any book, record, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, equipment, instrument or matter has been seized under this Act, the authorized officer who effected the seizure may, after referring to the Public Prosecutor, release the book, record, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, equipment, instrument or matter to the person as he determines to be lawfully entitled to it, if the book, record account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, equipment, instrument or matter is not liable to forfeiture under this Act and is not otherwise required for the purpose of any proceedings under this Act or for the purpose of any prosecution under any other written law, and in such event neither the authorized officer effecting the seizure, nor the Federal Government, Commission or any person acting on behalf of the Federal Government or Commission shall be liable to any proceedings by any person if the seizure and the release of the book, record, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, equipment, instrument or matter had been effected in good faith. (2) A record in writing shall be made by the authorized officer effecting the release of the book, record, account, document, computerized data, signboard, card, letter, pamphlet, leaflet, notice, equipment, instrument or matter under subsection (1) specifying in detail the circumstances of and the reason for the release, and he shall send a copy of the record to the Public Prosecutor within seven days of the release.

Pelepasan buku, rekod, akaun, dokumen, dsb., yang disita

(1) Jika apa-apa buku, rekod, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kelengkapan, peralatan atau perkara telah disita di bawah Akta ini, pegawai yang diberi kuasa yang membuat penyitaan itu boleh, selepas merujuk kepada Pendakwa Raya, melepaskan buku, rekod, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kelengkapan, peralatan atau perkara itu kepada orang yang ditentukan olehnya sebagai berhak secara sah kepadanya, jika buku, rekod, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kelengkapan, peralatan atau perkara itu tidak boleh dilucuthakkan di bawah Akta ini dan tidak dikehendaki selainnya bagi maksud apa-apa prosiding di bawah Akta ini atau bagi maksud apaapa pendakwaan di bawah mana-mana undang-undang bertulis yang lain, dan sekiranya sedemikian tiada pegawai yang diberi kuasa yang membuat penyitaan itu, mahu pun Kerajaan Persekutuan, Suruhanjaya atau mana-mana orang yang bertindak bagi pihak Kerajaan Persekutuan atau Suruhanjaya boleh dikenakan apa-apa prosiding oleh mana-mana orang jika penyitaan dan pelepasan buku, rekod, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kelengkapan, peralatan atau perkara itu telah dibuat dengan suci hati. (2) Suatu rekod bertulis hendaklah dibuat oleh pegawai yang diberi kuasa yang membuat pelepasan buku, rekod, akaun, dokumen, data berkomputer, papan tanda, kad, surat, risalah, lembaran, notis, kelengkapan, peralatan atau perkara di bawah subseksyen (1) yang menyatakan secara terperinci hal keadaan dan sebab bagi pelepasan itu, dan dia hendaklah menghantarkan suatu salinan rekod itu kepada Pendakwa Raya dalam tempoh tujuh hari dari pelepasan itu.
