s 11 Non-compliance with direction of Director General
(1) An employer who fails to comply with the direction of the Director General under paragraph 8(5)(b) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit.
(2) If an employer has been convicted of an offence under subsection (1), the court before which the employer has been convicted may order the employer to pay to the employee the amount directed by the Director General to be paid under paragraph 8(5)(b).
(3) If an employer fails to comply with an order made under subsection (2), the court may, on the application of an employee, issue a warrant to levy the employer’s property for the amount ordered to be paid under subsection (2) in the following manner:
(a) by way of distress and sale of the employer’s property in accordance with the same procedure of execution under the Subordinate Courts Rules 1980 [P.U. (A) 328/1980] and this execution shall apply mutatis mutandis notwithstanding the amount ordered to be paid; or
(b) in the same manner as a fine as provided under section 283 of the Criminal Procedure Code [Act 593].

Ketidakpatuhan kepada arahan Ketua Pengarah
(1) Seseorang majikan yang tidak mematuhi arahan Ketua Pengarah di bawah perenggan 8(5)(b) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit.
(2) Jika seseorang majikan telah disabitkan dengan suatu kesalahan di bawah subseksyen (1), mahkamah yang di hadapannya majikan itu disabitkan boleh memerintahkan majikan itu membayar pekerja itu jumlah yang diarahkan oleh Ketua Pengarah supaya dibayar di bawah perenggan 8(5)(b).
(3) Jika majikan tidak mematuhi perintah yang dibuat di bawah subseksyen (2), mahkamah boleh, atas permohonan seseorang pekerja, mengeluarkan suatu waran untuk melevi harta majikan itu bagi mendapatkan amaun yang diperintahkan supaya dibayar di bawah subseksyen (2) dengan cara yang berikut:
(a) secara distress dan penjualan harta majikan itu mengikut tatacara pelaksanaan yang sama di bawah *Kaedah- Kaedah Mahkamah Rendah 1980 [P.U.(A) 328/1980] dan pelaksanaan ini hendaklah terpakai mutatis mutandis

walau apa pun amaun yang diperintahkan untuk dibayar; atau
(b) mengikut cara yang sama seperti suatu denda sebagaimana yang diperuntukkan di bawah seksyen 283 Kanun Tatacara Jenayah [Akta 593].
