Where it appears to the Bank that there is a reasonable likelihood that any person will contravene or has contravened or will breach or has breached or is likely to fail to comply with or has failed to comply with any—
(a) provisions of this Act;
(b) provisions of any regulations made pursuant to this Act;
(c) order made or direction issued by the Bank under this Act including an order made under section 94 or a direction issued under section 116 or 156, subsection 214(6) or section 216;
(d) standards, condition, restriction, specification, requirement or code made or issued pursuant to any provision of this Act; or
(e) action taken by the Bank under subsection 234(3),
the Bank may institute civil proceedings in the court seeking any order specified under subsection 240(1) against that person whether or not that person has been charged with an offence in respect of the contravention or breach or whether or not a contravention or breach has been proved in a prosecution.

Jika Bank mendapati bahawa terdapat kebarangkalian munasabah bahawa mana-mana orang akan melanggar atau telah melanggar atau akan mungkir atau telah memungkiri atau berkemungkinan untuk gagal mematuhi atau telah gagal mematuhi mana-mana—
(a) peruntukan Akta ini;
(b) peruntukan mana-mana peraturan-peraturan yang dibuat menurut Akta ini;
(c) perintah yang dibuat atau arahan yang dikeluarkan oleh Bank di bawah Akta ini termasuk suatu perintah yang dibuat di bawah seksyen 94 atau suatu arahan yang dikeluarkan di bawah seksyen 116 atau 156, subseksyen 214(6) atau seksyen 216;
(d) standard, syarat, sekatan, penentuan, kehendak atau kod yang dibuat atau dikeluarkan menurut mana-mana peruntukan Akta ini; atau
(e) t i n d a k a n y a n g d i a m b i l o l e h B a n k d i b a w a h subseksyen 234(3),
Bank boleh memulakan prosiding sivil di mahkamah memohon apa-apa perintah yang ditentukan di bawah subseksyen 240(1) terhadap orang itu sama ada orang itu telah dituduh dengan suatu kesalahan berkenaan dengan pelanggaran atau kemungkiran itu atau sama ada suatu pelanggaran atau kemungkiran telah dibuktikan dalam suatu pendakwaan.
