s 52 Closure order

(1) The Director General may, on matters concerning public health and safety, or persistent use of unsafe or unhygienic practices, issue an order to close any premises, building or facility that is used for the provision of traditional and complementary medicine services for such period and on such prescribed terms as may be specified therein. (2) The effect of a closure order issued under subsection (1) is that the premises, building or facility is not to be used in the practice of that practice area, but such closure order shall not affect any other activities at the premise, building or facility which are not activities of that practice area. (3) All closure orders issued by the Director General shall contain the grounds and reasons for the order. (4) Upon the issuance of the order under subsection (1), the authorized officer may enter the premises, building or facility to inform the occupants of the order and he shall thereafter proceed to close the premises, building or facility, and shall use a mark, seal, sign, barrier, lock or device to indicate its closure, or any item which will indicate its closure. (5) Any person who tampers, alters, removes, breaks or modifies any mark, seal, sign, barrier, lock, device to or any item which will indicate that the premises, building or facility is subject to a closure order, or in any other way contravenes the closure order, commits an offence and shall, on conviction, be liable— (a) in respect of a first offence, to a fine not exceeding thirty thousand ringgit or to imprisonment for a term not exceeding two years or to both; and (b) in respect of a subsequent offence, to fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both. (6) Upon the expiry of the period specified in the order issued under subsection (1), the Director General may extend the period of closure if there is sufficient cause to do so. (7) The Director General may revoke the order made under subsection (1) and allow the premise, building or facility to be used for the provision of traditional and complementary medicine services. (8) A registered practitioner who is dissatisfied with the decision of the Director General made under subsection (1) may appeal to the Minister in accordance with the regulations made under this Act.

Perintah penutupan

(1) Ketua Pengarah boleh, atas perkara melibatkan kesihatan dan keselamatan awam, atau penggunaan berterusan amalan tidak selamat dan tidak bersih, mengeluarkan suatu perintah untuk menutup mana-mana premis, bangunan atau kemudahan yang digunakan untuk membekalkan perkhidmatan atau barangan perubatan tradisional dan komplementari untuk tempoh dan termaterma yang ditetapkan sebagaimana yang dinyatakan di dalam perintah tersebut. (2) Kesan suatu perintah penutupan yang dikeluarkan di bawah subseksyen (1) adalah bahawa premis, bangunan atau kemudahan tidak boleh digunakan dalam pengamalan bidang amalan yang berkenaan, tetapi perintah penutupan itu hendaklah tidak menjejaskan apa-apa kegiatan lain di premis, bangunan atau kemudahan yang bukan kegiatan bidang amalan yang berkenaan. (3) Segala perintah penutupan yang dikeluarkan oleh Ketua Pengarah mestilah mengandungi alasan dan sebab untuk perintah itu. (4) Atas pengeluaran perintah di bawah subseksyen (1), pegawai diberi kuasa boleh memasuki premis, bangunan atau kemudahan untuk memberitahu penghuni tentang perintah itu dan dia hendaklah selepas itu, terus menutup premis, bangunan atau kemudahan dan hendaklah menggunakan suatu tanda, meterai, isyarat, rintangan, kunci atau alat untuk menandakan penutupannya, atau apa-apa barangan yang akan menandakan penutupannya. (5) Mana-mana individu yang cuba merosakkan, mengubah, menanggalkan, memecahkan atau mengubah apa-apa tanda, meterai, isyarat, rintangan, kunci, alat atau apa-apa barang yang akan menandakan bahawa premis, bangunan atau kemudahan adalah tertakluk kepada suatu perintah penutupan, atau dalam mana-mana cara lain melanggar perintah penutupan, melakukan suatu kesalahan dan boleh, apabila disabitkan— (a) berkenaan dengan kesalahan pertama, didenda tidak melebihi tiga puluh ribu ringgit atau dipenjarakan bagi suatu tempoh tidak melebihi dua tahun atau keduaduanya; dan (b) berkenaan dengan kesalahan seterusnya, didenda tidak melebihi lima puluh ribu ringgit atau dipenjarakan bagi suatu tempoh tidak melebihi tiga tahun atau keduaduanya. (6) Sebaik tamat tempoh yang dinyatakan dalam perintah yang dikeluarkan di bawah subseksyen (1), Ketua Pengarah boleh melanjutkan tempoh penutupan jika terdapat alasan yang memadai untuk membuat demikian. (7) Ketua Pengarah boleh membatalkan perintah yang dibuat di bawah subseksyen (1) dan membenarkan premis, bangunan atau kemudahan untuk digunakan bagi penyediaan perkhidmatan perubatan tradisional dan komplementari. (8) Pengamal berdaftar yang tidak berpuas hati dengan keputusan Ketua Pengarah yang dibuat di bawah subseksyen (1) boleh merayu kepada Menteri mengikut peraturan-peraturan yang dibuat di bawah Akta ini.
