Sales Tax Act 2018 s 85

s 85 No costs or damages arising from seizure to be recoverable unless seizure without reasonable or probable cause

No person shall, in any proceedings before any court in respect of the seizure of any goods, documents, articles or things in exercise or the purported exercise of any power conferred under this Act, be entitled to the costs of the proceedings or to any damages or other relief, other than an order for the return of such goods, documents, articles or things or the payment of the value of such goods, documents, articles or things, unless such seizure was made without reasonable or probable cause.

Tiada kos atau ganti rugi yang berbangkit daripada penyitaan boleh didapatkan balik melainkan jika penyitaan dibuat tanpa sebab yang munasabah atau sebab yang barangkali

Tiada seorang pun, dalam apa-apa prosiding di hadapan mana-mana mahkamah berkenaan dengan penyitaan apa-apa barang, dokumen, artikel atau benda dalam menjalankan atau berupa sebagai menjalankan apa-apa kuasa yang diberikan di bawah Akta ini, berhak untuk mendapatkan kos prosiding itu atau apa-apa ganti rugi atau relief lain, selain suatu perintah bagi pemulangan barang, dokumen, artikel atau benda itu atau pembayaran nilai barang, dokumen, artikel atau benda itu, melainkan jika penyitaan itu telah dibuat tanpa sebab yang munasabah atau sebab yang barangkali.
