Republic Act

AUTHORIZING FEMALE MILITARY MEMBERS OF THE ARMED FORCES OF THE PHILIPPINES TO MARRY UPON COMPLETION OF THREE YEARS ACTIVE SERVICE.

Number
Presidential Decree No. 1910
Date of approval
Sections
4
Preamble

WHEREAS, Section 5 of Republic Act Number 3825 provides that

officers and enlisted personnel of the Women's Auxiliary Corps who contract

marriage shall be automatically separated or discharged from the service;

WHEREAS, Presidential Decree Number 1043 modifies the

restriction by setting five years of continuous active service as a prerequisite

before any member of the Women's Auxiliary Corps can marry without being

separated or discharged from the service;

WHEREAS, similar current AFP regulations governing members

of Nurse Corps, contain the same restriction applied to the officers and

enlisted women of the Women's Auxiliary Corps;

WHEREAS, this restriction causes demoralization especially

among those who honestly feel that their rights are violated by such laws and

regulations which limit their solemn and inherent prerogative to contract

marriage anytime and that such restriction is prejudicial their welfare since it

is not applied to their civilian counterparts in other government service.

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the

Philippines by virtue of the powers vested in me by the Constitution, do hereby

order and decree that:

Section 1

SECTION 1. Any female commissioned officer or enlisted woman

contracts marriage en or after the approval of this Act while in the active

service shall be automatically separated unless she has, at the time of said

marriage, already completed at least three (3) years of continuous active

military service in the Armed Forces of the Philippines. Provided, that any

female member of the AFP who was previously separated or discharged honorably by

reason of marriage may be called to active duty or reinstated subject to the

above condition and in accordance with rules and regulations as the Chief of

Staff, AFP may prescribe.

Section 2

SEC. 2. Any law, decree, letters of instructions,

presidential or executive orders, rules and regulations inconsistent with this

Act, are hereby repealed or modified accordingly.

Section 3

SEC. 3. This decree shall take effect upon its approval.

Done in the City of Manila, this 22nd day of March in the year of Our Lord,

Nineteen Hundred and Eighty-Four.
