Section 44 — Disposal of antecedent documents or instruments following creation of folio

(1)Upon creating a folio for any land under the provisions of this Act, or where, in the Registrar’s opinion, documents or instruments lodged with the Land Titles Registry need no longer be retained, the Registrar —

(a)must return or deliver to the person from whom the Registrar received the documents or instruments or to any other person entitled thereto any documents or instruments lodged or deposited with the Registrar; and

(b)may, in relation to the documents or instruments that are retained —

(i)transfer them to the National Archives of Singapore to be preserved for historical purposes; or

(ii)subject to subsection (2), dispose or destroy them after having them microfilmed or imaged.[8/2014]

(2)The Registrar must not destroy any document or instrument unless with the authorisation of the National Library Board under section 17 of the National Library Board Act 1995.[25/2012; 8/2014]
