The Channel Tunnel Rail Link (Nomination) Order 1997

Section 1

This Order may be cited as the Channel Tunnel Rail Link (Nomination) Order 1997 and shall come into force on 21st January 1997.

Section 2

In this Order, except where the context otherwise requires, any reference to—

(a) a numbered Part is a reference to the Part so numbered in the Channel Tunnel Rail Link Act 1996;

(b) a numbered section is a reference to the section so numbered in that Act;

(c) a numbered Schedule is a reference to the Schedule so numbered in that Act; and

(d) the excluded works is to:

(i) Works Nos. 4AA, 4C, 4D, 4E, 4F, 4G, 4H, 4K, 4MM, 4N, 4P, 4Q, 4R, 4S and 5R;

(ii) such parts of the works comprised within Works Nos. 4A, 4L or 4J as are indicated in blue on the drawing marked “The Channel Tunnel Rail Link (Nomination) Order 1997; drawing no. D/EI/488-040/000023/0A”, signed by authority of the Secretary of State for Transport, dated 30th December 1996, and deposited in the Department of Transport Information Centre, Great Minster House, 76 Marsham Street, London SW1P 4DR; and

(iii) such parts of the works authorised by Part I as are comprised within the description of the Thameslink Completion works set out in the Schedule below.

Section 3

(1) Eurostar ( U.K. ) Limited shall be the nominated undertaker for all purposes of such provisions of Part I as are specified below (being some of the provisions in which the nominated undertaker is expressly referred to), other than in relation to the excluded works:

(a) sections 1, 7, 8, 27, 28, 30, 32, 36, 37 and 39; and

(b) Schedules 1 to 8, Part I of Schedule 9, and Schedules 10, 11 and 15.

(2) Eurostar (U.K.) Limited shall in addition be the nominated undertaker for the purposes of any other provision of Part I so far as relating to or consequential on the matters set out in the provisions referred to in paragraph (1) above.
