Section 1 Citation, commencement and interpretation

(1) These Regulations may be cited as the Merchant Shipping (Vessels in Commercial Use for Sport or Pleasure) (Amendment) Regulations 2016 and come into force on 6th April 2016.

(2) In these Regulations, “the 1998 Regulations ” means the Merchant Shipping (Vessels in Commercial Use for Sport or Pleasure) Regulations 1998 .

Section 2 Amendment of the 1998 Regulations

After regulation 9 of the 1998 Regulations insert—

(1) The Secretary of State must from time to time—

(a) carry out a review of these Regulations;

(b) set out the conclusions of the review in a report, and

(c) publish the report.

(2) In carrying out the review the Secretary of State must, so far as is reasonable, have regard to how the European obligations or any other international obligations of the United Kingdom (which are implemented by means of these Regulations) are implemented in other member States or countries which are subject to those obligations.

(3) The report must in particular—

(a) set out the objectives intended to be achieved by the regulatory system established by these Regulations,

(b) assess the extent to which those objectives are achieved, and

(c) assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.

(4) The first report under this regulation must be published before the end of the period of five years beginning with 6th April 2016.

(5) Reports under this regulation are afterwards to be published at intervals not exceeding five years.

Section 3 Amendment of the 1998 Regulations

(1) Substitute the table in Schedule 1 to these Regulations (which contains a list of Regulations relating to safety of vessels which do not apply to large vessels which comply with a relevant Code of Practice) for the table in Schedule 1 to the 1998 Regulations.

(2) Substitute the table in Schedule 2 to these Regulations (which contains a list of Regulations relating to safety of vessels which do not apply to small vessels which comply with a relevant Code of Practice) for the table in Schedule 2 to the 1998 Regulations.
