Section 1 Citation and commencement

This Order may be cited as the Blood Safety and Quality Regulations and the Care and Support (Business Failure) Regulations (Consequential Amendments) Order 2018 and comes into force on 1st April 2018.

Section 2 Amendment of the Blood Safety and Quality Regulations 2005

In regulation 1 (citation, commencement and interpretation) of the Blood Safety and Quality Regulations 2005 , in paragraph (3)—

(a) in the definition of “care home” —

(i) in paragraph (a), omit “and Wales”;

(ii) at the end of paragraph (b), omit “and”;

(iii) in paragraph (c), after “2003” insert—

, and

in Wales, means a place at which a care home service, within the meaning of Paragraph 1 of Schedule 1 of the Regulation and Inspection of Social Care (Wales) Act 2016 , is provided wholly or mainly to persons aged 18 or over

(b) in the definition of “registered person” —

(i) at the end of paragraph (a), omit “and”;

(ii) in paragraph (b), omit “Wales,”;

(iii) at the end of paragraph (b), insert—

and

in Wales,—

the person registered with Social Care Wales as the manager of a place at which a care home service, within the meaning of Paragraph 1 of Schedule 1 of the Regulation and Inspection of Social Care (Wales) Act 2016, is provided wholly or mainly to persons aged 18 or over , or

the person registered as the manager of an independent hospital or independent clinic following an application to be registered as such pursuant to section 12(3) of the Care Standards Act 2000 ;

Section 3 Amendment of the Care and Support (Business Failure) Regulations 2015

(1) The Care and Support (Business Failure) Regulations 2015 are amended as follows.

(2) In regulation 1 (citation, commencement and interpretation), in paragraph (4), in the definition of “a provider”—

(a) at the end of paragraph (b), omit “or”;

(b) in paragraph (c), after “agency” insert—

, or

a person registered under Part 1 of the Regulation and Inspection of Social Care (Wales) Act 2016;

(3) In regulation 2 (business failure), in paragraph 1(b), after “agency” insert “or a regulated service, within the meaning of section 2 of the Regulation and Inspection of Social Care (Wales) Act 2016,”.
