Section 1 Citation, Commencement and Extent

(1) These Regulations may be cited as the Misuse of Drugs and Misuse of Drugs (Designation) (Amendment) (England, Wales and Scotland) Regulations 2021 and come into force on 18th August 2021.

(2) These Regulations extend to England and Wales and Scotland.

Section 2 Amendment of the Misuse of Drugs Regulations 2001

(1) The following amendments are made to Schedule 1 to the Misuse of Drugs Regulations 2001 (controlled drugs subject to the requirements of regulations 14, 15, 16, 18, 19, 20, 23, 26 and 27).

(2) In paragraph 1(a)—

(a) after “Etryptamine” insert “Flualprazolam (8-chloro-6-(2-fluorophenyl)-1-methyl-4H-[1,2,4]triazolo[4,3-a][1,4]benzodiazepine)”;

(b) after “Flubromazolam (8-Bromo-6-(2-fluorophenyl)-1-methyl-4 H -[1,2,4]triazolo[4,3-a][1,4] benzodiazepine)” insert “Flunitrazolam (6-(2-fluorophenyl)-1-methyl-8-nitro-4H-[1,2,4]triazolo[4,3-a][1,4]benzodiazepine)”;

(c) after “Nitrazolam (1-Methyl-8-nitro-6-phenyl-4 H -[1,2,4]triazolo[4,3-a][1,4]benzodiazepine)” insert “Norfludiazepam (7-chloro-5-(2-fluorophenyl)-1,3-dihydro-2H-1,4-benzodiazepin-2-one)”.

Section 3 Amendment of the Misuse of Drugs (Designation) (England, Wales and Scotland) Order 2015

(1) The following amendments are made to Schedule 1 to the Misuse of Drugs (Designation) (England, Wales and Scotland) Order 2015 (controlled drugs to which section 7(4) of the Misuse of Drugs Act 1971 applies).

(2) In paragraph 1(a)—

(a) after “Etryptamine” insert “Flualprazolam (8-chloro-6-(2-fluorophenyl)-1-methyl-4H-[1,2,4]triazolo[4,3-a][1,4]benzodiazepine)”;
