Section 1Title, commencement and application

(1) The title of this Order is the Education (National Curriculum) (Attainment Targets and Programmes of Study) (Wales) Order 2008 and, subject to articles 4(1), 5(1), 6(1), 7(1), 8(1), 9(1), 10(1), 11(1), 12(1), 13(1), 14(1) and 15(1) and (2) below, it comes into force on 1 August 2008.

(2) This Order applies in relation to Wales.

Section 2Interpretation

(1) In this Order—

“the art and design document” (“ y ddogfen celf a dylunio ”) means the document published by the Welsh Ministers in January 2008 entitled “Art and design in the National Curriculum for Wales” ;

“the design and technology document” (“ y ddogfen dylunio a thechnoleg ”) means the document published by the Welsh Ministers in January 2008 entitled “Design and technology in the National Curriculum for Wales”(

“the English document” (“ y ddogfen Saesneg ”) means the document published by the Welsh Ministers in January 2008 entitled “English in the National Curriculum for Wales”(

“the geography document” (“ y ddogfen ddaearyddiaeth ”) means the document published by the Welsh Ministers in January 2008 entitled “Geography in the National Curriculum for Wales” ;

“the history document” (“ y ddogfen hanes ”) means the document published by the Welsh Ministers in January 2008 entitled “History in the National Curriculum for Wales” ;

“the information and communication technology document” (“ y ddogfen technoleg gwybodaeth a chyfathrebu ”) means the document published by the Welsh Ministers in January 2008 entitled “Information and communication technology in the National Curriculum for Wales” ;

“the mathematics document” (“ y ddogfen fathemateg ”) means the document published by the Welsh Ministers in January 2008 entitled “Mathematics in the National Curriculum for Wales” ;

“the modern foreign languages document” (“ y ddogfen ieithoedd tramor modern ”) means the document published by the Welsh Ministers in January 2008 entitled “Modern foreign languages in the National Curriculum for Wales” ;

“the music document” (“ y ddogfen gerddoriaeth ”) means the document published by the Welsh Ministers in January 2008 entitled “Music in the National Curriculum for Wales” ;

“the physical education document” (“ y ddogfen addysg gorfforol ”) means the document published by the Welsh Ministers in January 2008 entitled “Physical education in the National Curriculum for Wales” ;

“the science document” (“ y ddogfen wyddoniaeth ”) means the document published by the Welsh Ministers in January 2008 entitled “Science in the National Curriculum for Wales” ;

“the Welsh document” (“ y ddogfen Gymraeg ”) means the document published by the Welsh Ministers in January 2008 entitled “Welsh in the National Curriculum for Wales” ; and

references to the first, second, third and fourth key stages are to be interpreted in accordance with section 103 of the Education Act 2002.

Section 3Revocation and transitional provisions

(1) The Orders listed in the Schedule are revoked on 1 August 2008.

(2) Despite paragraph (1) the provisions of the Orders listed in the Schedule continue to apply to pupils in the second, third and fourth key stages until such time as the provisions of this Order apply to them.

Section 4Art and design

(1) The provisions of this Order insofar as they relate to the art and design document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the art and design document have effect for the purpose of specifying the attainment target and programmes of study in relation to art and design.

(3) The examples printed in italics in the art and design document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 5Design and technology

(1) The provisions of this Order insofar as they relate to the design and technology document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the design and technology document shall have effect for the purpose of specifying the attainment target and programmes of study in relation to design and technology.

(3) The examples printed in italics in the design and technology document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 6English

(1) The provisions of this Order insofar as they relate to the English document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage;

(c) 1 August 2010 in respect of pupils in the first year of the fourth key stage; and

(d) 1 August 2011 in respect of pupils in the second year of the fourth key stage.

(2) The provisions relating to attainment targets and programmes of study set out in the English document have effect for the purpose of specifying the attainment targets and programmes of study in relation to English.

(3) The examples printed in italics in the English document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 7Geography

(1) The provisions of this Order insofar as they relate to the geography document will come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the geography document have effect for the purpose of specifying the attainment target and programmes of study in relation to geography.

(3) The examples printed in italics in the geography document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 8History

(1) The provisions of this Order insofar as they relate to the history document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the history document have effect for the purpose of specifying the attainment target and programmes of study in relation to history.

(3) The examples printed in italics in the history document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 9Information and communication technology

(1) The provisions of this Order insofar as they relate to the information and communication technology document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the information and communication technology document have effect for the purpose of specifying the attainment target and programmes of study in relation to information and communication technology.

(3) The examples printed in italics in the information and communication technology document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 10Mathematics

(1) The provisions of this Order insofar as they relate to the mathematics document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage;

(c) 1 August 2010 in respect of pupils in the first year of the fourth key stage; and

(d) 1 August 2011 in respect of pupils in the second year of the fourth key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the mathematics document have effect for the purpose of specifying the attainment target and programmes of study in relation to mathematics.

(3) The examples printed in italics in the mathematics document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 11Modern foreign languages

(1) The provisions of this Order insofar as they relate to the modern foreign languages document come into force on—

(a) 1 August 2008 in respect of pupils in the first two years of the third key stage; and

(b) 1 August 2009 in respect of pupils in the third year of the third key stage.

(2) The provisions relating to attainment targets and programmes of study set out in the modern foreign languages document have effect for the purpose of specifying the attainment targets and programmes of study in relation to modern foreign languages.

(3) The examples printed in italics in the modern foreign languages document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 12Music

(1) The provisions of this Order insofar as they relate to the music document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage; and

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the music document have effect for the purpose of specifying the attainment target and programmes of study in relation to music.

(3) The examples printed in italics in the music document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 13Physical education

(1) The provisions of this Order insofar as they relate to the physical education document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage, the third year of the third key stage and the first year of the fourth key stage; and

(c) 1 August 2010 in respect of pupils in the second year of the fourth key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the physical education document have effect for the purpose of specifying the attainment target and programmes of study in relation to physical education.

(3) The examples printed in italics in the physical education document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 14Science

(1) The provisions of this Order insofar as they relate to the science document come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage, the first two years of the third key stage and in the fourth key stage; and

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage.

(2) The provisions relating to the attainment target and programmes of study set out in the science document have effect for the purpose of specifying the attainment target and programmes of study in relation to science.

(3) The examples printed in italics in the science document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 15Welsh

(1) The provisions of this Order insofar as they relate to that part of the Welsh document entitled “Welsh” comes into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage and the third year of the third key stage;

(c) 1 August 2010 in respect of pupils in the first year of the fourth key stage; and

(d) 1 August 2011 in respect of pupils in the second year of the fourth key stage.

(2) The provisions of this Order insofar as they relate to that part of the Welsh document entitled “Welsh second language” will come into force on—

(a) 1 August 2008 in respect of pupils in the first three years of the second key stage and the first two years of the third key stage;

(b) 1 August 2009 in respect of pupils in the fourth year of the second key stage, the third year of the third key stage and the first year of the fourth key stage; and

(c) 1 August 2010 in respect of pupils in the second year of the fourth key stage.

(3) The provisions relating to attainment targets and programmes of study set out in the Welsh document have effect for the purpose of specifying the attainment targets and programmes of study in relation to Welsh.

(4) The examples printed in italics in the Welsh document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.

Section 1

For the purposes of article 3(1) the following Orders are revoked —

(a) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Physical Education) (Wales) Order 2000 ;

(b) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Science) (Wales) Order 2000 ;

(c) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Mathematics) (Wales) Order 2000 ;

(d) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) Order 2000 ;

(e) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Art) (Wales) Order 2000 ;

(f) The Education (National Curriculum) (Attainment Targets and Programmes of Study in English) (Wales) Order 2000 ;

(g) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Geography) (Wales) Order 2000 ;

(h) The Education (National Curriculum) (Attainment Targets and Programme of Study in History) (Wales) Order 2000 ;

(i) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Modern Foreign Languages) (Wales) Order 2000 ;

(j) The Education (National Curriculum) (Attainment Targets and Programmes of Study in Music) (Wales) Order 2000 ; and

(k) The Education (National Curriculum) (Attainment Targets and Programme of Study in Technology) (Wales) Order 2000 .
