Section 1 Title, commencement and application

(1) The title of this Order is the Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2009 and it comes into force on 31 December 2009.

(2) This Order applies in relation to Wales.

Section 2 Classes of Fireplaces exempted from Section 20 of the Clean Air Act 1993

The classes of fireplaces described in the Schedule are, subject to the conditions listed, exempted from the provisions of Section 20 of the Clean Air Act 1993 (which prohibits smoke emissions in smoke control areas).

Section 3 Revocation

The Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2008 ( S.I. 2008/3101 (W.275) ) is revoked.
