Section 1Title and coming into force

(1) The title of these Regulations is the Education (Student Support) (Wales) (Amendment) Regulations 2026.

(2) These Regulations come into force on 31 July 2026.

Section 2Application

These Regulations apply in relation to the provision of support to a student in relation to an academic year which begins on or after 1 August 2026.

Section 3Amendment of the Education (Student Support) (Wales) Regulations 2018

The Education (Student Support) (Wales) Regulations 2018 are amended in accordance with regulations 4 to 6.

Section 4Amendment to regulation 8

After regulation 8(1) (designation of other courses) insert—

(1A) When specifying a course under paragraph (1), the Welsh Ministers may specify that the course is to be treated as being provided by an ordinary provider for the purposes of regulation 40(2)(c)(i).

Section 5Amendments to regulation 40

In regulation 40 (amount of tuition fee loan)—

(a) in paragraph (2), at the beginning insert “Subject to paragraph (4),” ;

(b) for paragraph (2)(c)(i) substitute—

(i) “ ordinary provider ” means a provider—

(aa) falling within Condition 4 of regulation 6(1),

(bb) specified in column 2 of Table 14A in Schedule 1A, in so far as they provide the course described in the corresponding entry in column 3, or

(cc) treated as such by virtue of a designation made by the Welsh Ministers under regulation 8;

(c) in paragraph (2)(c)(ii), at the end insert “, where the institution is not treated as an ordinary provider within the meaning of paragraph (i) under the terms of that designation” ;

(d) after paragraph (3) insert—

(4) The maximum loan amount to which a protected student is entitled is calculated as if their course were provided by an ordinary provider within the meaning of paragraph (2)(c)(i).

(5) In paragraph (4), “ protected student ” means a student undertaking a course that satisfies the requirements set out in Schedule 2A.

Section 6Insertion of new Schedule 2A

After Schedule 2 (categories of eligible student) insert—

Relevant courses for protected students

(1) A course described in column 3 of Table 14B that—

(a) is provided by the course provider specified in the corresponding entry in column 2,

(b) leads to a qualification awarded by the body specified in the corresponding entry in column 1, and

(c) begins before 1 August 2026.
