reg 56 Enforcement Powers
(1) Schedule 5 has effect where the enforcing authority is— (a) a weights and measures authority; (b) a district council; or (c) the Secretary of State. (2) Schedule 6 has effect where the enforcing authority is the HSE or the Office for Nuclear Regulation. (3) Schedule 7 has effect where the enforcing authority is the HSENI. (4) In addition to the powers available to an enforcing authority under, as appropriate, paragraph (1), (2) or (3), the authority may use the powers set out in Schedule 8.
