Regulation 28 is to be read as if paragraph (1) read— (1) Where an initiating body gives a notice of unauthorised development, or makes an order under section 90 of the 2024 Act, a section 97 or section 102 order granting permission for EIA development, they must prepare a statement setting out the information specified in paragraph (2).
