甲法官任職臺中地方法院已有很長一段時間，由於近來案件激增，因年 齡漸長，甲頗感力不從心，希望能離職轉任律師工作。由於甲長期於臺 中地方法院工作，對臺中相當孰悉，也希望能將臺中作為執業重點。惟 律師法第28 條規定，司法人員或公職律師自離職之日起3 年內，不得 在其離職前3 年內曾任職務之法院、檢察署、政府機關（構）或公立學 校執行律師職務。但其因停職、休職或調職等原因離開上開法院、檢察 署、政府機關（構）或公立學校已滿3 年者，不在此限。甲認為律師 法第28 條規定，違憲侵害其離開公職後之工作權，試評論甲之看法。 （25 分）
