s 12 Purchaser and developer to pay Charges, and contribution to sinking fund

(1) Each purchaser shall pay the Charges, and contribution to the sinking fund, in respect of his parcel to the developer for the maintenance and management of the buildings or lands intended for subdivision into parcels and the common property in a development area. (2) The developer shall pay the Charges, and contribution to the sinking fund, in respect of those parcels in the development area which have not been sold, being a sum equivalent to the Charges, and contribution to the sinking fund, payable by the purchasers to the developer had the parcels been sold. (3) The amount of the Charges to be paid under subsections (1) and (2) shall be determined by the developer in proportion to the allocated share units of each parcel. (4) The amount of contribution to the sinking fund to be paid under subsections (1) and (2) shall be a sum equivalent to ten per cent of the Charges. (5) The purchaser shall, within fourteen days of receiving a notice from the developer, pay the Charges, and contribution to the sinking fund, to the developer and if any sum remains unpaid by the purchaser in respect of his parcel at the expiry of the period of fourteen days, the developer may recover the sum in the manner set out in section 34. (6) If any sum remains unpaid by the purchaser in respect of his parcel at the expiry of the period of fourteen days specified in subsection (5), the purchaser shall pay interest at the rate of ten per cent per annum on a daily basis. (7) Any purchaser who is not satisfied with the sums determined by the developer under subsection (3) or (4) may apply to the Commissioner for a review and the Commissioner may— (a) determine the sum to be paid as the Charges, or contribution to the sinking fund; or (b) instruct the developer to appoint, at the developer’s own cost and expense, a registered property manager to recommend the sum payable as the Charges, or contribution to the sinking fund, and submit a copy of the registered property manager’s report to the Commissioner. (8) Upon receiving the report under paragraph (7)(b), the Commissioner shall determine the sum payable as he thinks just and reasonable, and any sum so determined by the Commissioner shall be deemed to be the sum payable as the Charges, or contribution to the sinking fund. (9) Any developer who fails to comply with subsection (2) commits an offence and shall, on conviction, be liable to a fine not exceeding twenty thousand ringgit or to imprisonment for a term not exceeding three years or to both and, in the case of a continuing offence, to a further fine not exceeding five thousand ringgit for every day or part thereof during which the offence continues after conviction.

Pembeli dan pemaju hendaklah membayar Caj, dan caruman kepada kumpulan wang penjelas

(1) Setiap pembeli hendaklah membayar Caj, dan caruman kepada kumpulan wang penjelas, berkenaan dengan petaknya kepada pemaju bagi penyenggaraan dan pengurusan bangunan atau tanah yang dicadangkan untuk dipecah bahagi kepada petak-petak dan harta bersama di dalam suatu kawasan pemajuan. (2) Pemaju hendaklah membayar Caj, dan caruman kepada kumpulan wang penjelas, berkenaan dengan petak di dalam kawasan pemajuan yang belum dijual, yang merupakan suatu jumlah wang yang bersamaan dengan Caj, dan caruman kepada kumpulan wang penjelas, yang kena dibayar oleh pembeli kepada pemaju sekiranya petak itu telah dijual. (3) Jumlah Caj yang kena dibayar di bawah subseksyen (1) dan (2) hendaklah ditentukan oleh pemaju mengikut kadar unit syer yang diumpukkan kepada setiap petak. (4) Jumlah caruman kepada kumpulan wang penjelas yang kena dibayar di bawah subseksyen (1) dan (2) hendaklah suatu jumlah wang yang bersamaan dengan sepuluh peratus daripada Caj. (5) Pembeli hendaklah, dalam masa empat belas hari dari penerimaan notis daripada pemaju, membayar Caj, dan caruman kepada kumpulan wang penjelas, kepada pemaju dan jika apaapa jumlah wang masih tidak dibayar oleh pembeli itu berkenaan dengan petaknya apabila habis tempoh empat belas hari itu, pemaju boleh mendapatkan jumlah wang itu mengikut cara yang dinyatakan dalam seksyen 34. (6) Jika apa-apa jumlah wang masih tidak dibayar oleh pembeli berkenaan dengan petaknya apabila habis tempoh empat belas hari yang dinyatakan dalam subseksyen (5), pembeli itu hendaklah membayar bunga pada kadar sepuluh peratus setahun atas dasar harian. (7) Mana-mana pembeli yang tidak berpuas hati dengan jumlah wang yang ditentukan oleh pemaju di bawah subseksyen (3) atau (4) boleh memohon kepada Pesuruhjaya untuk suatu kajian semula dan Pesuruhjaya boleh— (a) menentukan jumlah wang yang kena dibayar sebagai Caj, atau caruman kepada kumpulan wang penjelas itu; atau (b) mengarahkan pemaju untuk melantik, atas kos dan perbelanjaan pemaju sendiri, seorang pengurus harta berdaftar untuk mengesyorkan jumlah wang yang kena dibayar sebagai Caj, atau caruman kepada kumpulan wang penjelas, dan mengemukakan suatu salinan laporan pengurus harta berdaftar itu kepada Pesuruhjaya. (8) Apabila menerima laporan di bawah perenggan (7)(b), Pesuruhjaya hendaklah menentukan jumlah wang yang kena dibayar sebagaimana yang difikirkannya adil dan munasabah, dan apaapa jumlah wang yang ditentukan oleh Pesuruhjaya sedemikian hendaklah disifatkan sebagai jumlah wang yang kena dibayar sebagai Caj, atau caruman kepada kumpulan wang penjelas. (9) Mana-mana pemaju yang tidak mematuhi subseksyen (2) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi dua puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya dan, dalam hal suatu kesalahan berterusan, didenda selanjutnya tidak melebihi lima ribu ringgit bagi tiap-tiap hari atau sebahagiannya kesalahan itu berterusan selepas disabitkan.
