要旨

令函要旨

請 貴處惠予再次向世界智慧財產權組織（WIPO）相關官員查詢伯恩公約一八八六年取初訂定回溯保護條文之立法理由，該條條文其後歷次修正（西元一九○八年）之修正理由及其他相關文獻資料乙份供參，函請 查照。說明：一、貴處八十四年六月七日關貿（八四）字第三○七號函敬悉，本會刻依檢送資料深入研究中。二、又本案經本會初步研究，伯恩公約歷次回溯保護條文如左：(一)一八八六年第十四條：Article 14. Under the rwscrves and conditions to be determined bycommon agreement, this Convention shall apply to all works whichat the moment ofits cominginto force have yet fallen into thepublic domain in the country of origin.(二)一九○八年第十八條：Article 18. (1) This Convention shall apply to all works which, atthe moment ofits coming into foece, have not yet fallen into thepublic domain in the country of origin though the expiry of theterm of protection.(2) If, however, through the expiry of the termof protection was prcviously granted, a work has jallen intopublic donain of the country where protection is claimed, thateork shall not be protected ancw. (3) The apphcation of thisprinciple shall be subiect to any provisions contained in specialconcentions to that cffect existing or to be concluded betwecncountries of the Union. In the absence of such provisions, therespective countries shall detemine, each in so far as it isconcerned, the conditions of application of this principle.(4) Thepreceding provisions shall also apply in the casc of newaccessions to the Union, and to cases in which the term ofprotection is extended by the application of Article 7.(三)一九二八年第十八條：（一九六七年伯恩公約第十八條條文僅針對一九二八年伯恩公約第十八條第四項作細微文字修正，一九七一年伯恩公約第十八條文，即現行通用條文，其內容與一九六七年伯恩公約該條內容相同）Article 18.
