Section 1Title, citation and commencement

(1) This Order may be cited as the Social Security (Northern Ireland) Order 1982 and this Order and the Social Security (Northern Ireland) Acts 1975 to 1981 may be cited together as the Social Security (Northern Ireland) Acts 1975 to 1982.

(2) This Part and Articles 9, 28, 33 and 35 to 37 and paragraphs 1 to 3, 7, 10 (1) and (3), 14, 15 and 17 to 20 of Schedule 4 together with Article 38 so far as it relates to those paragraphs shall come into operation on 10th August 1982 and the remaining provisions of this Order shall come into operation on such day or days as the Head of the Department may by order appoint .

(3) An order under paragraph (2) may make such transitional provisions as appears to the Head of the Department to be necessary or expedient in connection with the provisions thereby brought into operation.

Section 2Interpretation

(1) The Interpretation Act (Northern Ireland) 1954 shall apply to Article 1 and the following provisions of this Order as it applies to a Measure of the Northern Ireland Assembly.

(2) In this Order—

“benefit” has the same meaning as in the principal Act;

“the Department” means the Department of Health and Social Services;

“the National Insurance Fund” means the Northern Ireland National Insurance Fund;

“principal Act” means the Social Security (Northern Ireland) Act 1975 ;

“regulations” means regulations made by the Department;

“statutory provision” has the same meaning as in section 1 (f) of the Interpretation Act (Northern Ireland) 1954;

“tax year” means the period of twelve months beginning with 6th April in any year.

Section 12Relationship with benefits and other payments, etc.

Schedule 2 shall have effect with respect to the relationship between statutory sick pay and certain benefits and payments and for the purposes of modifying other statutory provisions.

(5) Regulations may make such transitional or saving provision as the Department considers necessary or expedient in connection with the provisions of this Article.

Section 36Regulations and orders

(1) Section 165(4), (5) and (10) of the Social Security Administration (Northern Ireland) Act 1992 (which among other things make provision about the extent of powers to make orders and regulations) shall apply to any power to make orders or regulations conferred by this Order as they apply to any power to make orders or regulations conferred by that Act.

(2) Regulations and orders made by the Department under this Order, other than ... orders under Article 1(2), shall be subject to negative resolution.

Section 6

Paragraph 1 does not apply in relation to section 59 of the principal Act (increases in unemployability supplement) and accordingly the references in that section to a period of interruption of employment shall be construed as if Part II of this Order had not been made.
