This Order may be cited as the Merchant Shipping (Liability of Shipowners and Others) (Calculation of Tonnage) Order 1986 and shall come into operation on 1st December 1986.

The Merchant Shipping (Liability of Shipowners and Others) (Calculation of Tonnage) Order 1986
(1) For the purposes of article 6 of the Convention on Limitation of Liability for Maritime Claims 1976 and of paragraph 5 of Part II of Schedule 4 to the Merchant Shipping Act 1979, the gross tonnage of a ship shall be calculated in accordance with regulations 4 to 6 of the Merchant Shipping (Tonnage) Regulations 1982.
(2) In the case of a ship of which, at the time when limitation is claimed, the tonnage has not been and cannot be ascertained in accordance with paragraph (1) above, the best evidence available of the measurements of the ship shall be used in calculating the tonnage of the ship according to those regulations.
