Section 1 Citation and commencement

(1) This Order may be cited as the Essex (District Boundaries) Order 1987.

(2) This Order shall come into force on 1st January 1988 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976 .

(3) For all other purposes this Order shall come into force on 1st April 1988.

Section 2 Transfer from the district of Braintree to the district of Maldon

The area of the district of Braintree and the parish of Witham which is marked Area A on the map prepared by the Department of the Environment, marked “Map of the Essex (District Boundaries) Order 1987” and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976 shall be transferred to—

(a) the district of Maldon;

(b) the Wickham Bishops ward of that district;

(c) the parish of Wickham Bishops;

(d) the Tollesbury electoral division of the county of Essex;

(e) the Dengie and Maldon petty sessional division.

Section 3 Town and Country Planning

Any provisions of a local plan adopted by the Braintree District Council which apply immediately before 1st April 1988 to the area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the Maldon District Council.

Section 4 Land Registration

Registration of title to land under the Land Registration Acts 1925 to 1986 shall cease to be compulsory on sale in the area transferred by this Order save insofar as section 154(1) of the Housing Act 1985 applies to any dwelling-house situated in that area.
