Section 1Title and commencement

This order may be cited as the Nottinghamshire (District Boundaries) Order 1987.

Section 2Title and commencement

(1) 20th March 1987 is hereby specified as the day on which this order shall come into force for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976 .

(2) For all other purposes, this order shall come into force on 1st April 1987.

Section 3Interpretation

In this order—

“borough ward” means a ward of the borough of Gedling;

“boundary maps” means the 3 maps prepared by the Department of the Environment, marked “Maps of the Nottinghamshire (District Boundaries) Order 1987”, duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976; and

“county electoral division” means an electoral division of the county of Nottinghamshire.

Section 4Transfers from the borough of Gedling to the district of Newark and Sherwood

The areas of the borough of Gedling and of the parish of Burton Joyce which are marked D1, D2 and D3 on boundary map 2 shall be transferred to—

(a) the district of Newark and Sherwood;

(b) the Dover Beck ward of that district;

(c) the parish of Bulcote; and

(d) the Southwell county electoral division.

Section 5Transfers from the district of Newark and Sherwood to the borough of Gedling

(1) The areas of the district of Newark and Sherwood and of the parish of Bulcote which are marked C1, C2, C3 and C4 on boundary map 2 shall be transferred to—

(a) the borough of Gedling;

(b) the Burton Joyce and Stoke Bardolph ward of that borough;

(c) the parish of Burton Joyce; and

(d) the Trentside county electoral division.

(2) The areas of the district of Newark and Sherwood and of the parish of Blidworth which are marked A and B on boundary map 1 shall be transferred to the borough of Gedling and to the Gedling North county electoral division.

Section 6New parish and parish council of Ravenshead

(1) There shall be created in the borough of Gedling a new parish of Ravenshead which shall consist of—

(a) the areas transferred from the district of Newark and Sherwood to the borough of Gedling by article 5(2) above; and

(b) the area of the borough of Gedling and of the parish of Newstead which is marked F on boundary map 1.

(2) There shall be a parish council for the new parish.

(3) From 1st April 1987 until the fourth day after the ordinary day of election of councillors in that year, the parish council shall consist of the councillors of the borough of Gedling who represent the Newstead borough ward and the councillors of the district of Newark and Sherwood who represent the Fishpool district ward. Thereafter, the council shall consist of 11 parish councillors.

(4) The proper officer of the Gedling Borough Council shall convene the first annual meeting of the parish council of the new parish and the first assembly of the parish meeting for the new parish. If the first assembly of the parish meeting is held before the first annual meeting of the parish council, the parish meeting may appoint a person to take the chair who shall have, for the purpose of that occasion only, the powers and authority of the chairman.

(5) In the financial year beginning on 1st April 1987, the Gedling Borough Council shall levy rates in the new parish, and make payment to the new parish council, as if the new parish council had issued a precept to that borough council requiring the payment of a sum equal to the product of a rate of 2.5 pence in the pound, calculated on the total rateable value of the new parish as set out in the valuation list at the beginning of that financial year.

Section 7Consequential parish electoral alterations

(1) This article shall have effect from the fourth day after the ordinary day of elections in 1987.

(2) The parish of Blidworth in the district of Newark and Sherwood shall be divided into 2 parish wards, as shown on boundary map 1, to be called the Blidworth ward and the Rainworth ward, and to be represented by 7 and 6 parish councillors respectively.

(3) The parish of Newstead in the borough of Gedling shall be divided into 2 parish wards, as shown on boundary map 1, to be called the Newstead Village ward and the Newstead Abbey Park ward, and to be represented by 5 and 4 parish councillors respectively.

Section 8Borough and district electoral alterations

(1) There shall be created in the borough of Gedling a new borough ward, to be called the Ravenshead ward, which shall consist of the area of the new parish of Ravenshead created by article 6(1) of this order.

(2) From 1st April 1987 until the fourth day after the ordinary day of election of councillors in 1987 the new Ravenshead borough ward shall be represented by the district councillors representing the Fishpool ward of the district of Newark and Sherwood immediately before 1st April 1987. Thereafter it shall be represented by 3 borough councillors.

(3) From the fourth day after the ordinary day of election of councillors in 1987 the Newstead ward of the borough of Gedling shall be represented by 1 borough councillor.

(4) The Fishpool ward of the district of Newark and Sherwood shall be abolished, and the district councillors representing that ward shall retire from that office on 1st April 1987.

Section 9County electoral arrangements

(1) This article shall have effect from the fourth day after the ordinary day of election of councillors in 1989.

(2) The electoral divisions of the county of Nottinghamshire which consist of areas within the borough of Gedling shall be abolished. The area of the borough of Gedling shall be divided into 9 county electoral divisions which shall bear the names set out in column 1 of the Schedule to this order, and each electoral division shall comprise the relevant areas specified in column 2 of that Schedule.

(3) The number of councillors to be elected for each electoral division constituted by paragraph (2) above shall be 1.

Section 10Town and Country Planning

Any provisions of a local plan adopted by a borough or district council which apply immediately before 1st April 1987 to an area transferred by this order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the council of the borough or district to which that area is transferred.
