Section 1 Application, citation and commencement

(1) This Order shall apply to the Wolverhampton urban development area.

(2) This Order may be cited as the Town and Country Planning (Wolverhampton Urban Development Area) Special Development Order 1988 and shall come into force on 31st August 1988.

Section 2 Interpretation

In this Order, “Wolverhampton urban development area” means the area designated as an urban development area by the Wolverhampton Urban Development Area Order 1988 .

Section 3 Permitted development

(1) The Town and Country Planning (Black Country Urban Development Area) Special Development Order 1987 shall have effect to permit development within the Wolverhampton urban development area in the circumstances in which, and to the same extent as, and subject to the same limitations, conditions and restrictions as, it is permitted by that order in the area designated as an urban development area by the Black Country Development Corporation (Area and Constitution) Order 1987 , and, accordingly, the first mentioned order shall have effect subject to the modifications mentioned in paragraph (2).

(2) The modifications mentioned in paragraph (1) are—

(i) in article 1(1), the insertion at the end of the words “and the Wolverhampton urban development area”;

(ii) in article 2, the substitution for the definition of “the development area” of—

“the development area” means the areas designated as urban development areas by the Black Country Development Corporation (Area and Constitution) Order 1987 and the Wolverhampton Urban Development Area Order 1988;

(iii) in article 6(2)(f), the substitution of the words “the development area” for “their area”.
