Section 1 Citation and commencement

These Regulations may be cited as the Agriculture Improvement (Amendment) (No. 3) Regulations 1988 and shall come into force on 29th November 1988.

Section 2 Amendment of the Agriculture Improvement Regulations 1985

Regulation 7 of the Agriculture Improvement Regulations 1985 (closing dates for submission of improvement plans) shall be amended—

(a) by substituting for paragraph (1) thereof the following paragraph—

(1) Subject to paragraphs (2) and (3) below, the appropriate Minister shall not approve an improvement plan under these Regulations where the plan is received by him on or after 29th November 1988 or such later date, not later than 28th December 1988, as that Minister may in special circumstances permit.

(b) by inserting after paragraph (2) thereof the following paragraph—

(3) Paragraph (1) above shall not apply where the improvement plan includes only proposed expenditure—

(a) in connection with any work, facility or transaction which is of a kind specified in paragraph 9 or 10 in column 1 of Schedule 1 (glasshouse heating systems and heated glasshouses), or

(b) in the Isles of Scilly in connection with any work, facility or transaction which is of a kind specified in any of paragraphs 1 to 5 in column 1 of Schedule 2.
