Section 1Citation, commencement and interpretation

(1) This Order may be cited as the Housing Support Grant (Scotland) Order 1988 and shall come into force on 1st April 1988.

(2) In this Order—

“the 1987 Act ” means the Housing (Scotland) Act 1987;

“appropriate local authority” means a local authority other than an authority whose eligible expenditure and relevant income have been left out of account by virtue of section 191(5) of the 1987 Act;

“hostel” means a hostel as defined in section 2(5) of the 1987 Act;

“the number of houses of the authority” means the estimate of the number of houses to which the housing revenue account of the authority at 30th September 1988 relates.

(3) Except where the context otherwise requires—

(a) any reference to a numbered article or Schedule is a reference to the article or Schedule bearing that number in this Order; and

(b) any reference to an estimate is a reference to an estimate made by the Secretary of State.

Section 2Aggregate grant for 1988-89

The aggregate amount of the housing support grants for 1988-1989 shall be £54,631,469.

Section 3Apportionment of housing support grants for 1988-89

(1) The aggregate amount of the housing support grants for the year 1988-89 shall be divided into two portions hereinafter referred to as the “general portion” and the “hostel portion”.

(2) The general portion shall amount to £53,847,393 and shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures assessed in the manner provided in the Schedule to this Order.

(3) The hostel portion shall amount to £784,076 and shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures for the year 1988-89 on the provision of hostels and lodging houses.

Estimated loan charges due to be debited to the authority’s housing revenue account for the year 1988-89 under paragraph 3(a) of Schedule 15 to the 1987 Act (other than loan charges in respect of hostels and lodging houses).

Section 2Basic amount for supervision and management ( SM ).

£76.691678 multiplied by the number of houses of the authority.

Section 3Additional SM factor for certain houses.

(a) £30.676671 in the case of an authority with not more than 3,000 houses, or

(b) £15.338335 in the case of an authority with more than 3,000 but not more than 6,000 houses, or

(c) £7.669168 in the case of an authority with more than 6,000 but not more than 9,000 houses, multiplied in each case by the number of houses of the authority.

Section 4Basic amount for repairs and maintenance ( RM ).

£229.655638 multiplied by the number of houses of the authority.

Section 5Additional RM factors for certain urban expenditure.

£355.966242 multiplied by the number of high-rise houses of the authority contained in blocks of flats which are of fifteen or more storeys.

Section 6Additional RM factors for certain urban expenditure.

£160.758948 multiplied by the number of high-rise houses of the authority contained in blocks of flats which are of more than four but not more than fourteen storeys, with lifts.

Section 7Additional RM factors for certain urban expenditure.

Estimated other miscellaneous expenditure which may properly be included in the authority’s housing revenue account.

Section 8Basic income amount.

£907.51 multiplied by the number of houses of the authority excluding certain houses leased by the authority for short term occupation without, or with nominal, rental income.

Section 9Basic income amount.

A figure, to represent rate fund contributions, calculated for each authority—

(a) by multiplying £10 million by the most up to date estimate then available for that authority’s council house stock at 30 September 1988 and dividing by the estimated council house stock in Scotland, again at 30 September 1988;

(b) by taking the lower of the figure thus derived and the 1987-88 rate fund contribution limit for the Council as specified in the Housing Revenue Account Rate Fund Contribution Limits (Scotland) Order 1987 .

Section 10Basic income amount.

Estimated other miscellaneous income which may properly be included in the authority’s housing revenue account.
