Section 1Citation and commencement

(1) This Order may be cited as the Cheshire (District Boundaries) Order 1988.

(2) This part shall come into force on 22nd February 1988 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976 .

(3) For all other purposes this Order shall come into force on 1st April 1988.

Section 2Transfer from the district of Vale Royal to the City of Chester

The part of the district of Vale Royal and parish of Delamere which is shown coloured yellow on the map prepared by the Department of the Environment, marked“Map of the Cheshire (District Boundaries) Order 1988” and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976 shall be transferred to:—

(a) the City of Chester;

(b) the Barrow ward of that City;

(c) the parish of Kelsall;

(d) the Gowy electoral division of the county of Cheshire;

(e) the Chester petty sessional division.

Section 3Town and Country Planning

Any provisions of a local plan adopted by the Vale Royal District Council which apply immediately before 1st April 1988 to the area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the Chester City Council.
