Section 1 Citation and commencement

(1) This Order may be cited as the Derbyshire (District Boundaries) Order 1988.

(2) This Order shall come into force on 22nd February 1988 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976 .

(3) For all other purposes this Order shall come into force on 1st April 1988.

Section 2 Interpretation

In this Order—

“borough ward” means a ward of the borough of Chesterfield;

“boundary map” means one of the 5 maps prepared by the Department of the Environment, marked “Maps of the Derbyshire (District Boundaries) Order 1988”, duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

“county electoral division” means an electoral division of the county of Derbyshire;

“district ward” means a ward of the district of North East Derbyshire.

Section 3 Transfers between districts

The areas marked on the boundary map as shown in columns 1 and 2 of the Schedule to this Order shall cease to be part of the relevant local government areas named in column 3, and shall become part of the relevant local government areas named in column 4 and of the borough or district ward and the county electoral division named in column 5.

Section 4 Town and Country Planning

Any provisions of a local plan adopted by the council of a district which apply immediately before 1st April 1988 to an area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the council of the district to which the area is transferred.
