Section 1 Citation and commencement

These Regulations may be cited as the Building (Amendment of Prescribed Fees) Regulations 1988 and shall come into force on 13th June 1988.

Section 2 Amendment of the Building (Prescribed Fees etc. ) Regulations 1985

The Building (Prescribed Fees etc.) Regulations 1985 are amended as follows—

(1) in Schedule 1 there shall be substituted—

(a) for “£75” in paragraphs 2 and 5, “£80”, and

(b) for Tables 1 and 2, the following Tables—

Plan fee for erection of small domestic building

Inspection fee for erection of small domestic building

(2) in Schedule 2 there shall be substituted—

(a) in paragraph 1 for “£10”, “£30” and “£40” respectively, “£11”, “£33” and “£44”, and

(b) for the Table in paragraph 2, the following Table—

Fees for certain domestic extensions and alterations

(1) An extension or alteration consisting of the provision of one or more rooms in roof space, including means of access.

(2) Any extension (not falling within paragraph 1 above) the total floor area of which does not exceed 20mu22, including means of access.

(3) Any extension (not falling within paragraph 1 above) the total floor area of which exceeds 20mu22 but does not exceed 40mu22, including means of access.

Section 3 Transitional Provisions

These Regulations shall not affect the application of the Building (Prescribed Fees etc ) Regulations 1985 in relation to work in respect of which—

(1) a building notice was given or full plans were deposited (under regulation 11 of the Building Regulations 1985 ); or

(2) an initial notice or a public body’s notice was given (under section 47(1) or 54(1) of the Building Act 1984),

before 13th June 1988, notwithstanding that on or after that date a notice is or has been given, or plans are or have been deposited, in respect of substantially the same work.

Section 4 Revocations

Regulations 2(3)(a) and (c) and (4) of the Building (Amendment of Prescribed Fees) Regulations 1986 are hereby revoked.
