Section 1Citation and commencement

These Regulations may be cited as the Education (School Premises) (Amendment) Regulations 1989 and shall come into force on 1st September 1989.

Section 2Amendment of the Education (School Premises) Regulations 1981

(1)

(a) In the definition of “school” in regulation 3(1) of the Education (School Premises) Regulations 1981 , for the words ““school” means a school maintained by a local education authority” there shall be substituted the words ““school” means a grant-maintained school or a school maintained by a local education authority”.

(b) In the definition of “new school buildings” in that paragraph, after the words “section 14(1) of the Education Act 1980” there shall be inserted the words “or section 90(1) of the Education Reform Act 1988” .

(2) In regulation 3(3) of those Regulations, after sub-paragraph (b) there shall be inserted the following sub-paragraph –

(c) in the case of a grant-maintained school, by the governing body of the school
