Section 1

This Order may be cited as the Copyright, Designs and Patents Act 1988 (Isle of Man) (No. 2) Order 1990 and shall come into force on 7th January 1991.

Section 2

(1) Paragraphs 1 to 11, 17 to 23, 25, 26, 28 and 30 of Schedule 5 to the Copyright, Designs and Patents Act 1988 shall extend to the Isle of Man subject to the modification specified in paragraph (3) below.

(2) Section 303(2) of and Schedule 8 to the Copyright, Designs and Patents Act 1988 shall extend to the Isle of Man so far as they relate to the repeal of the following provisions of the Patents Act 1977 —

(a) sections 14(4) and (8);

(b) in section 28(3), paragraph (b) and the word “and” preceding it;

(c) section 28(5) to (9);

(d) sections 72(3) and 88;

(e) in section 130(7), the words “88(6) and (7)”, and

(f) n Schedule 5, paragraphs 2, 7 and 8.

(3) The modification referred to in paragraph (1) above is that any reference to an Act of Parliament or to a provision of such an Act shall be construed, unless the contrary intention appears, as a reference to that Act or provision as it has effect in the Isle of Man.
