Section 1 Citation

This Order may be cited as the Environmental Protection Act 1990 (Commence ment No. 10) Order 1991.

Section 2 Provisions coming into force on 13th December 1991

The following provisions of the Environmental Protection Act 1990 shall come into force on 13th December 1991–

section 33(3) and (4);

section 34(5), (7) to (9) and (11);

section 52(8) in so far as it relates to section 52(1) and (3);

section 78.

Section 3 Provisions coming into force on 1st January 1992

The following provisions of the Environmental Protection Act 1990 shall come into force on 1st January 1992–

section 144 in so far as it relates to Part I of Schedule 13;

section 162(2) in so far as it relates to the repeals in Part VII of Schedule 16 relating to the Planning (Hazardous Substances) Act 1990 .

Section 4 Provisions coming into force on 1st April 1992

The following provisions of the Environmental Protection Act 1990 shall come into force on 1st April 1992–

section 33(1)(c);

section 33(2) and (6) to (9) in so far as they relate to section 33(1)(c);

section 34 (in so far as not already in force);

section 69;

section 70;

section 162(1) in so far as it relates to paragraphs 10 and 31 of Schedule 15 (in so far as not already in force);

section 162(2) in so far as it relates to the following repeals in Schedule 16–

in Part II, the repeal of section 9(2) of the Control of Pollution (Amendment) Act 1989 ;

in Part VI, the repeals relating to the Nature Conservancy Council Act 1973 .
