Section 1Citation and commencement

(1) This Order may be cited as the Dorset and Somerset (County Boundaries) Order 1991.

(2) This Order shall come into force on 18th March 1991 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976 .

(3) For all other purposes this Order shall come into force on 1st April 1991.

Section 2Interpretation

In this Order “boundary map” means the map prepared by the Department of the Environment marked “Map of the Dorset and Somerset (County Boundaries) Order 1991”, duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976.

Section 3Transfers from Dorset to Somerset

(1) The part of the county of Dorset, the district of West Dorset and the parish of Bradford Abbas marked A1 on the boundary map shall be transferred to—

(a) the county of Somerset and the Coker electoral division of that county;

(b) the district of South Somerset and the Coker ward of that district;

(c) the parish of Barwick;

(d) the Yeovil petty sessional division;

(e) the Eastern Somerset Coroner’s district.

(2) The part of the county of Dorset, the district of West Dorset and the Parish of Clifton Maybank marked A2 on the boundary map shall be transferred to—

(a) the county of Somerset and the Coker electoral division of that county;

(b) the district of South Somerset and the Coker ward of that district;

(c) the parish of Barwick;

(d) the Yeovil petty sessional division;

(e) the Eastern Somerset Coroner’s district.

Section 4Town and country planning

Any provision of a development plan applying to an area transferred by this Order shall continue to apply thereto notwithstanding the transfer; and after such transfer, any such provision shall, so far as it so applies, be for all purposes deemed to be a provision of a corresponding plan of the authority which becomes the appropriate local planning authority for the transferred area as a result of the transfer.
