Section 1Citation and commencement

(1) This Order may be cited as the Cheshire and Greater Manchester (County and District Boundaries) Order 1992.

(2) This Order shall come into force on 22nd September 1992 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976 .

(3) For all other purposes, this Order shall come into force on 1st April 1993.

Section 2Interpretation

In this Order—

“Cheshire” means the county of Cheshire, and “Macclesfield” or “Warrington” means, in either case, the Cheshire borough of that name;

“electoral division” means an electoral division of Cheshire;

“Greater Manchester”means the metropolitan county of Greater Manchester, “Manchester” means the city of Manchester, and “Trafford” means the metropolitan borough of Trafford;

“the map” means one of the 15 maps prepared by the Department of the Environment, marked “Maps of the Cheshire and Greater Manchester (County and District Boundaries) Order 1992”, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

any reference to an area as “unparished” is a reference to that area not forming part of any parish; and

“ward”means a ward of the borough, city or metropolitan borough from or to which an area is transferred.

Section 3Transfers between Cheshire (Macclesfield and Warrington) and Greater Manchester (Trafford)

Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from the county, district and parish (or, where unparished, the ward) named in column 3 to the county, district, parish, petty sessional division and coroner’s district named in column 4.

Section 4Transfers within Greater Manchester from Manchester to Trafford

Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Manchester, and from the ward (and parish, if any) named in column 3 to Trafford, and to the ward named in column 4, to the Trafford petty sessional division, and to the Greater Manchester South coroner’s district, and shall be unparished.

Table

Section 5Transfers within Greater Manchester from Trafford to Manchester

Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Trafford, and from the ward named in column 3 to Manchester, to the ward (and parish, if any) named in column 4, to the Manchester petty sessional division, and to the Manchester coroner’s district.

Section 6Town and country planning

(1) In this article, “provision” means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990 ).

(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.
