The Reconstitution of the River Ouzel Internal Drainage Board Order 1993

Section 1

This Order may be cited as the Reconstitution of the River Ouzel Internal Drainage Board Order 1993 and shall, unless subject to special Parliamentary procedure, come into force on the date of its confirmation by the Minister, in accordance with paragraph 5(1) of Schedule 3 to the 1991 Act.

Section 2

The Scheme is hereby confirmed subject to the following modifications:

(i) for paragraph 1 of the Scheme there shall be substituted:“This Scheme shall come into force one month after the date of confirmation of the Order confirming this Scheme.”;

(ii) for paragraph 2 there shall be substituted:

The Internal Drainage Board as constituted by the Great Ouse River Board (River Ouzel Internal Drainage District) Order 1952 ( S.I. 1952/1244 , 1245 ) (hereinafter referred to as “the 1952 Order—”) as amended by the Anglian Water Authority (Alteration of Boundaries of the River Ouzel Internal Drainage District) Order 1976 (S.I. 1976/1562 ) shall be reconstituted such that the number of elected members shall be twelve, provided that the existing members of the Internal Drainage Board shall continue in office until the date of the first meeting of the new members under paragraph 3(2) of Schedule 2 to the Land Drainage Act 1991.

Section 3

The expenses of the Minister in connection with the making and confirmation of this Order shall be borne by the National Rivers Authority.

Section 1

This Scheme shall come into force on the date of confirmation of the Order confirming this Scheme.

Section 2

The Internal Drainage Board as constituted by the Great Ouse River Board (River Ouzel Internal Drainage District) Order 1952 S.I.1952 Nos 1244 and 1245 (hereinafter referred to as “the 1952 Order”) as amended by the Anglian Water Authority (Alteration of Boundaries of the River Ouzel Internal Drainage District) Order 1976 S.I.1976 No.1562 shall be reconstituted and shall consist of 12 members who, with the exception of the first members, shall be persons elected in accordance with the provisions of section 1 of, and Schedule 1 to, the 1991 Act.The first members shall be appointed by the Minister and shall hold office until the expiration of one year from the 1st November next following the day on which they are appointed.

Section 3

The existing rights, powers, duties, liabilities, obligations and property (including deeds, maps, books, papers and other documents) of the River Ouzel Internal Drainage Board as constituted by the 1952 Order shall be the rights, powers, duties, liabilities, obligations and property of the Internal Drainage Board as reconstituted by this Scheme.
