Section 1

This Order may be cited as the A550 and A5117 Trunk Roads (Improvement between Deeside Park and Ledsham) and Connecting Roads Order 1994 and shall come into force on 30th September 1994.

Section 2

In this Order:

(a) all measurements of distance are measured along the route of the relevant highway;

(b)

(i) “the main new roads” means the new highways which the Secretaries of State propose to construct along the routes described in Schedule 1 to this Order;

(ii) “the new trunk roads” means the main new roads and the connecting roads;

(iii) “the plan” means the plan numbered HA10/1/CNW 336 marked “The A550 and A5117 Trunk Roads (Improvement between Deeside Park and Ledsham) and Connecting Roads Order 1994”, signed by the Secretary of State for Transport, and the Secretary of State for Wales;

(iv) “the connecting roads” means the new highways which the Secretaries of State propose to construct along the routes described in Schedule 2 to this Order, each to connect a main new road or the A550 (Welsh Road) with other highways or proposed highways described in that Schedule;

(v) “the A550” and “themean, respectively, the A550 Trunk A5117” Road and the A5117 Trunk Road; and

(vi) “the side roads order” means the A550 and A5117 Trunk Roads (Improvement between Deeside Park and Ledsham) and Connecting Roads (Side Roads) Order 1994.

Section 3

The main new roads and the connecting roads shall become trunk roads from the date when this Order comes into force.

Section 4

The centreline of each of the new trunk roads is indicated by a heavy black line on the plan.

Section 5

The Secretaries of State direct as respects any part of a highway which crosses the route of any of the new trunk roads that—

(a) where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and

(b) where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretaries of State shall be under no duty to maintain the part in question,

until in either case, a date to be specified in a notice given to the highway authority for that highway by the Secretary of State for Transport, in respect of a highway in England, or the Secretary of State for Wales, in respect of a highway in Wales. The date specified will not be later than the date on which the relevant route is opened for traffic.

Section 1

A route from the northbound carriageway of the A550 (Welsh Road) to a new high level roundabout at Deeside Park which the Secretaries of State propose to construct pursuant to the side roads order (this route being given the reference number 1 on the plan).

Section 2

A route from that new roundabout to the northbound carriageway of the A550 (Welsh Road) at Shotwick Park which the Secretaries of State propose to improve (this route being given the reference number 2 on the plan).

Section 3

A route from the southbound carriageway of the main new road given the reference letter C to that new roundabout (this route being given the reference number 3 on the plan).

Section 4

A route from the southbound carriageway of the main new road given the reference letter A to the connecting road given the reference number 3 (this route being given the reference number 4 on the plan).

Section 5

A route from the connecting road given the reference number 2 to the main new road given the reference letter C (this route being given the reference number 5 on the plan).

Section 6

Four routes to connect the main new road given the reference letter B with a new roundabout which the Secretaries of State propose to construct at Ledsham pursuant to the side roads order (the connecting roads along these routes being given the numbers 6, 7, 8 and 9 respectively on the plan).
