This Order may be cited as the Education (School Curriculum and Assessment Authority) (Transfer of Functions) Order 1994 and shall come into force on 1st April 1994.

The Education (School Curriculum and Assessment Authority) (Transfer of Functions) Order 1994
In this Order—
“The 1993 Act ” means the Education Act 1993;
“ ACAC ” means Awdurdod Cwricwlwm ac Asesu Cymru or the Curriculum and Assessment Authority for Wales ;
“ The Authority ” means the School Curriculum and Assessment Authority ;
“Fourth Key Stage” refers to the period set out in paragraph (d) of section 3(3) of the Education Reform Act 1988 ;
(1) Subject to paragraph (2) below, there are hereby transferred to ACAC, in relation to Wales, all the Authority ’s functions under subsection (1) of Section 245 of the 1993 Act as are exercisable in relation to both England and Wales.
(2) Except in relation to Welsh, paragraph (1) above does not extend to the Authority’s functions relating to the examination and assessment of pupils in the fourth Key Stage or above.
